MICROfll.MW momn 9643482 BK 2773 PG 283 OFFICIAL RECORDS OF MDHAVE COUNTY, ( JOAN MC CALL, MOHAVE COUNTY RECORDEr 08/07/96 02:17P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 96-277 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR MAUNA LANI VILLAGE, TRACT 4149, BEING A SUBDIVISION OF A PORTION OF SECTION 15, TOWNSIDP 17 NORTH, RANGE 22 WEST, IN THE SOUTH MOHA VE V ALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 5, 1996, a public hearing was conducted to determine whether approval should be granted for an Extension of Time as requested by owner/developer Michael J. Mangana of Owen Development, Mohave Valley, Arizona, for the above described Preliminary Subdivision Plan. The engineer of record for the project is Civiltec Engineering, Inc. of Monrovia, California, and WHEREAS, the subdivision is located approximately twelve and one-haif miles south of Bullhead City. The property is accessed via State Highway 95, then southwest on Harbor A venue, then northwesterly along and north of Levee Drive, and WHEREAS, the Preliminary Plan depicts 9.42 acres subdivided into 42 single-family residential lots, ranging in size from 8,000 to 13,750 square feet, and WHEREAS, the owner/developer has indicated in a letter dated May 10, 1996, that an Extension of Time is being requested based on the following: "...In order to build first-class single-family projects on the land, we will need some additional time. ...lfthe economy would spark up, we would be in a position to obtain assurances, record our Final Plats, and begin construction. ...We feel confident that Mauna Lani Village and Mauna Kea Village are good, solid, feasible projects. Hopefully, next year we can get them under way.", and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on August 3, 1992, per BOS Resolution No. 92-257. The first Extension of Time for the approved Preliminary Plan was granted on April 4, 1994, per BOS Resolution No. 94-97. The second extension was granted on August 7, 1995, per BOS Resolution No. 95-318. Subdivision Regulation Article 3.10-1 states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated.", and WHEREAS, a Final Plat and Improvement Plans were submitted for county review in June, 1993. A review letter dated July 23, 1993 was sent to the engineer, requesting necessary changes. To date there has been no response to this letter, and no action has been taken toward the recordation ofthe plat, and RESOLUTION NO. 96-277 Page 2 .....;....-...... . . WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any additional submittals of this project for processing, the adequacy of the drainage and compatibility of this proposed subdivision with surrounding development will be reviewed, and has recommended that any required changes or modifications will be the responsibility of the developer, and WHEREAS, this will be the third Extension of Time, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action complies with the Mohave County General Plan, and the property is designated as an Urban Development Area. c. The site is adequate for the action intended and the proposal is consistent with the surrounding land uses. d. This request does not comply with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 10, 1996, the Commission recommended APPROVAL of an Extension of Time for the Preliminary Plan subject to the following conditions: 1. Compliance with all conditions of BaS Resolution Nos. 92-257, 94-97, and 95-318. 2. Unless significant progress is made in the coming year toward the recordation of this project, Planning staff will recommend denial of any additional Extensions of Time for this Preliminary Plan. 3. This Extension of Time will be in effect until August 3, 1997. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 20, 1996, and posted on July 19, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOL YED, that the Board of Supervisors at their regular meeting on Monday, August 5,1996, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ~,::'t: .:;:' ~" ::iL'~(;"~"X~~~~/~;_,...
