MOHAVE COUNTY RECORDEr 08/07/96 02:1~P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 96-274 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 4, BLOCK 221 AND LOT 1, BLOCK 222, VIRGIN ACRES, TRACT NO. I, IN SECTION 32, TOWNSHIP 41 NORTH, RANGE 15 WEST, FOR A WELL PUMP SITE, WATER STORAGE TANK AND RELATED ITEMS IN AN A-R ZONE, IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 5, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by the Beaver Dam Water Company, being represented by Bob Frisby, President, of Beaver Dam, Arizona, and WHEREAS, this property is located west of US Highway 91 and northwest of the Littlefield Interchange, in the Littlefield area. The site is accessed from Highway 91 via west on a local road known as "Old Pioneer Road" to the southern boundary of Section 32, then west on a public road not named in Virgin Acres approximately one-half mile to the site on the north side. The property is vacant and flat, sloping slightly to the east. The surrounding land uses consist of vacant land and a few single-family residences. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant requests this Zoning Use Permit for an existing well pump site, water storage tank and related items. The Mohave County General Plan designates this area as a Rural Development Area and an Outlying community, and WHEREAS, a review ofFEMA FIRM Panel #040058-0025B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 10, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 96-274 Page 2 ~ - . . The applicant shaH comply with all applicable provisions of the Mohave County Zoning Regulations. 3. The appropriate zoning, building, environmental and floodplain permits wiH be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shaH terminate at that date. 5. TIlls Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission !lll.d Board, the contin\led use of the property would be contrary to the public health, safety and welfare. 6. The applicant shall obtain an approval to construct and an approval of construction from the Arizona Department of Environmental Quality (ADEQ). WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 20, 1996, and posted July 19, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 5,1996, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
