WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 1, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by Ralph and Caroline V. Dietz of Golden Valley, Arizona, and WHEREAS, this property is located north of the City of Kingman, east of Stockton Hill Road and north of College Drive between Casey Lane and Ty Street. The site is accessed from Stockton Hill Road via east on College Drive to the site, located on the northwest comer of College Drive and Ty Street. The property is vacant and flat. The surrounding land uses consist of other vacant lots and lots with single family residences on them. All the residences along the south side of College Drive are contractor constructed homes while the majority of the homes along the north side of College are manufactured homes. There are no significant drainage patterns that cross the property, and WHEREAS, the applicant requests this zone change to allow for resale and to allow the option of placing a mobile home on these lots. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2l65C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. b. c. All notices have been advertised and posted according to regulations. The proposed action and the effect complies with the Mohave County General Plan. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. The neighboring area contains other like land uses similar to the above proposed action. The site has legal access. There are no significant environmental features affecting the site. d. e. f. PAGE 2 OF 2 BK 2757 PG 325 FEE~9636760 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 12, 1996, the Commission recommended DENIAL for a Rezone based upon the following: I. This rezoning constitutes spot zoning. The lots along the north side of College Drive are zoned R-O (Single Family ResidentialIMobile Homes Prohibited). WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 16, 1996, and posted June 14, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July I, 1996, DENIED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
