RESOLUTION NO. 96-252
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 543, GOLDEN
HORSESHOE RANCHOS, UNIT 1, IN SECTION 9, TOWNSHIP 27 NORTH, RANGE 20 WEST,
FOR A WATER TANK IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE MOHA VE
COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July I,
1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above described property as requested by the Golden Horseshoe Ranchos Landowners Association Unit I,
being represented by Ralph J. McGrath, President, of Phoenix, Arizona, and
WHEREAS, this property is located east of US Highway 93 and north of White Hills Road. The
site is accessed from Highway 93 via east on White Hills Road to a Road and Utilities Easement (RD & UE)
located approximately three and one-half miles east of Highway 93, then north on this RD & UE
approximately one mile where it joins Hitching Post Road, then continuing north to the site located on the
southwest comer of Hitching Post Road and Indian Peak Drive. The property has a well and water tank on
it and is relatively flat, sloping slightly to the southwest. The surrounding land uses consist of vacant lots
and several single family residences to the south. There is Bureau of Land Management (BLM) land to the
north, northeast and east. There are no significant drainage patterns crossing the property, and
WHEREAS, the applicant requests this Zoning Use Permit to allow a 20,000-gallon water holding
tank and future expansion. The Mohave County General Plan designates this area as a Rural Development
Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-1600B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
June 12, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Permit is for a 20,000-gallon water holding tank and future expansion and
activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations.
3. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety and welfare.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, June 16, 1996, and posted June 14, 1996, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, July 1, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
