MlOOOflLMED INDEXED RESOLUTION NO. 96-250 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 186, IN SECTION 29, TOWNSHIP 23 NORTH, RANGE 16 WEST, FOR A SECONDARY RESIDENCE IN AN A-R/I0A (AGRICUL TURAL-RESIDENTIAL/fEIS ACRE MINIMUM LOT SIZE) ZONE IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 1, 1996, a pubIic hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Dayton and Betty J. Lundy of Kingman, Arizona, and WHEREAS, this property is located east of Stockton Hill Road, north of the City of Kingman. The site is accessed from Stockton Hill Road via east on Wilks Ranch Road to Cherum Road, then south on Cherum Road to Calle Parral, then east on Calle Parral to the site located on the north side of Calle Parral approximately 500 feet east of Avenida del Burro. The property has a single family residence on it and the southern portion of the lot along Calle Parral is relatively flat, sloping to the southwest, while the northern portion rises rather sharply. The surrounding land uses consist of vacant lots and a few single family residences. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in an A- R/lOA (Agricultural-Residentialffen Acre Minimum Lot Size) zone. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2l55B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 12, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: ~ .... . . RESOLUTION NO. 96-250 PAGE 2 OF 2 BK 2757 PG 313 FEE~9636754 Page 2 I. This Zoning Use Permit is for a secondary residence on this property and the activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27.R (Accessory or Secondary Residence Requirements), and a site plan in accordance with Section 27.R must be completed and approved prior to approval of permits. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 16, 1996, and posted June 14, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July I, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
