WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 1, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Charles and Nancy Davis of Dolan Springs, Arizona, and WHEREAS, this property is located east of US Highway 93 and north of Pierce Ferry Road in the Lake Mohave Commercial Center in Dolan Springs. The site is accessed from Highway 93 via northeast on Pierce Ferry Road approximately five and three-quarter miles to the site, located on the northwest side of Pierce Ferry Road. The property has a second-hand store on the front portion and the rear portion is vacant. The surrounding land uses consist of other commercial businesses. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant requests this Zoning Use Permit to allow for a flea market/swap meet behind the second-hand store, approximately 15 to 20 spaces with security lights and within a fenced-in area. The Mohave County General Plan designates this area as a Rural Development Area and an Outlying Community, and WHEREAS, a review ofFEMA FIRM Panel #040058-1800C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 12, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: ,. . This Zoning Use Permit is for a flea market/swap meet behind the second-hand store, approximately 15 to 20 spaces with security lights and within a fenced-in area, and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. If this development creates additional impervious areas, a Limited Drainage Report will have to be submitted including a method for the on-site mitigation of any additional runoff created. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction, 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 16, 1996, and posted June 14, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July 1, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
