WY. OF SECTION 8, TOWNSHIP 20 NORTH, RANGE 17 WEST, LYING BETWEEN THE SOUTHERLY RIGHT-OF-WAY LINE OF HIGHWAY 66 AND THE NORTHERLY RIGHT-OF-WAY LINE OF THE AT&SF RAILROAD FROM A-R/I0A (AGRICULTURAL-RESIDENTIALffEN ACRE MINIMUM LOT SIZE) ZONE TO M12A (GENERAL MANUFACTURINGffWO ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July I, 1996, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for the above described property as requested by Darryl Smith of Kingman, Arizona, and WHEREAS, this property is located southwest of the Interstate 40/McConnico Interchange between Highway 66 and the AT&SF Railroad, southwest of the City of Kingman. The site is accessed from Interstate 40 via the McConnico Interchange, then east to the Frontage Road, then southwest on the Frontage Road to the site. The property has been leveled and the owner is in the process of erecting the fence. Equipment and some materials have been moved to the site; part of the material is being used for the fence on the property. There are no significant drainage patterns crossing the property. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, Mr. Smith's site plan for the property is presently in review with the Planning and Zoning Department. In addition, he has constructed the view-obscuring fence along Highway 66/Interstate 40 side of his property, and WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on June 1, 1992 via BOS Resolution No. 92-195. It was extended for the first time with BOS Resolution No. 93-220 on August 2, 1993. A second extension was granted on August 9, 1994, via BOS Resolution No. 94-271. A third extension was granted via BOS Resolution No. 95-292 on July 5, 1995. BOS Resolution No. 92-195 was amended on September 5,1995 with BOS Resolution No. 95-376, and WHEREAS, this Extension of Time will allow the applicant to complete the site plan required by Mohave County Zoning Regulations, Section 27.P, to complete the fence and the other conditions as required by BOS Resolution Nos. 92-195 and 95-376, and WHEREAS, this will be the fourth Extension of Time, and ... . . PAGE 2 OF 2 BK 2757 PG 294 FEE~9636745 RESOLUTION NO. 96-241 Page 2 WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. g. This request complies with the Extension of Time Policy; Mr. Smith is making considerable effort to complete the conditions of this Rezone. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 12, 1996, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Continued compliance with the conditions ofBOS Resolution Nos. 92-195 and 95-376. 2. This Extension of Time will be in effect until June 1, 1997. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 16, 1996, and posted June 14, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July I, 1996, APPROVED this Extension of Time for a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
