RESOLUTION NO. 96-240
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF LOT 258, IN
THE SWy. NE'I. OF SECTION 11, TOWNSHIP 21 NORTH, RANGE 19 WEST, FOR A
RESIDENCE IN A C-2H12A (GENERAL COMMERCIAL HIGHWAY FRONT AGEffWO ACRE
MINIMUM LOT SIZE) ZONE, IN THE GOLDEN VALLEY AREA, MOHA VE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 1,
1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above described property as requested by Arlen C. Kagay of Santa Fe Springs, California, and
WHEREAS, this property is located south of State Highway 68 between Milky Way Road and
Estrella Road. The site is accessed from Highway 68 directly to the site on the south side of the highway.
The property has a building and a towing and storage facility on it. The surrounding land uses consist of
vacant property and several lots with residences on them. There are no significant drainage patterns crossing
the property, and
WHEREAS, the applicant requests this Zoning Use Permit for a residence in a C-2H/2A (General
Commercial Highway Frontage/Two Acre Minimum Lot Size) zone. The Mohave County General Plan
designates this area as an Urban Development Area, and
WHEREAS, a site plan in accordance with Mohave County Zoning Regulations, Section 27.P (Site
Plan Requirements), has been submitted to the Planning and Zoning Department and is in the review process
at this time, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site, except for the noted
Special Flood Hazard Area.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
June 12, I996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Permit is for a residence in a C-2H/2A (General Commercial Highway
Frontage /Two Acre Minimum Lot Size) zone and activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations.
3. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety and welfare.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, June 16, 1996, and posted June 14, 1996, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, July 1, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
