MlCROALME/J INDEXED RESOLUTION NO. 96-233 A RESOLUTION SETIING FORTH A ZONING USE PERMIT ON LOT 49, BLOCK B, GOLDEN SHORES, UNIT 5, IN SECTION 11, TOWNSHIP 16 NORTH, RANGE 21 WEST, FOR A WATER STORAGE TANK, WELL, HYDROPNEUMATIC TANK AND ACCESSORY PUMPS AND PIPING IN A R-l (SINGLE FAMILY RESIDENTIAL) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 1, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Linda Boyer of the Golden Shores Water Company in Topock, Arizona, being represented by G. Kelly Grier of Burton Engineering, Inc., Bullhead City, Arizona, and WHEREAS, this property is located east of the Oatman- Topock Highway (Old Highway 66) and north of Powell Lake Road in the Golden Shores area. The site is accessed from State Highway 95 via east and southeast on County Route I to the Golden Shores area and Powell Lake Road, then east on Powell Lake Road to Pima Parkway, then north on Pima Parkway to the site. The site is located between Pima Parkway and Apache Parkway on the north side of Pima Parkway at its intersection with Pima Drive, and is accessed via an easement either from Pima Parkway or Apache Parkway. The property has a water storage tank, well, hydropneumatic tank and accessory pumps and piping. The property is landscaped and has a view-obscuring fence around it. The surrounding land uses consist of single family residences and vacant lots. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant requests this Zoning Use Permit for a water storage tank, well, hydropneumatic tank and accessory pumps and piping for the Golden Shores Water Company. The Mohave County General Plan designates this area as a Rural Development Area and an Outlying Community, and WHEREAS, a review ofFEMA FIRM Panel #040058-2805C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. RESOLUTION NO. 96-233 Page 2 . .. . . PAGE 2 OF 2 BK 2757 PG 276 FEE~9636737 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 12, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: I. This Zoning Use Permit is for a water storage tank, well, hydropneumatic tank and accessory pumps and piping for the Golden Shores Water Company and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 3. If the use has been discontinued for six months after Board approval of the Zoning Use Permit, then approval shall terminate at that date. 4. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 16, 1996, and posted June 14, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July 1,1996, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
