RESOLUTION NO. 96-355
A RESOLUTION SETTING FORTH A REZONE OF PARCEL 18, LAZY YoU RANCH, PHASE
I, AMENDED, IN SECTION 10, TOWNSHIP 20 NORTH, RANGE 16 WEST, FROM A-R/36A
(AGRICUL TURAL-RESIDENTIALITHlRTY -SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/
9A, A-R/7 A AND A-R/5A (AGRICUL TURAL-RESIDENTIAL/NINE ACRE, SEVEN ACRE AND
FIVE ACRE MINIMUM LOT SIZE) ZONES, IN THE MOHA VE COUNTY GENERAL AREA,
MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October
7, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the
above described property as requested by David E. and Cindy D. Hollingsworth of Kingman, Arizona, and
WHEREAS, this property is located southeast of the City of Kingman, and south of Hualapai
Mountain Road. The site is accessed from Hualapai Mountain Road via southwest and then northwest on
Lazy Y -U Drive to Surrey Drive, then southwest on Surrey Drive to the site approximately one-quarter mile
from Lazy YoU Drive. The property is vacant and the terrain is hilly, sloping to the northwest. The
surrounding land uses consist of vacant land and several single-family residences. There appears to be a
minor drainage pattern crossing from east to west in the northern one-half of the parcel, and
WHEREAS, the applicant requests this zone change to allow for residential development. The
applicant proposes to divide the 39.96-acre parcel into five parcels; two parcels approximately 5 acres, one
parcel approximately 7.3 acres, one parcel 9.0 acres and one parcel 11.0 acres. All are net acreage. The
Mohave County General Plan designates this area as a Rural Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2350B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the State of Arizona Department of Real Estate may consider the split of this parcel
and the split of Parcel 23, LAZY YoU RANCH, Phase I, Amended, by Mr. Hollingsworth as a subdivision,
and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.

d. The neighboring area contains other like land uses similar to the above proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
September 11, 1996, the Commission recommended APPROVAL for a Rezone subject to the following:
1. The three western parcels be rezoned A-R/5A (Agricultural-ResidentiallFive Acre Minimum
Lot Size), the southeastern parcel will be rezoned A-Rl7 A (Agricultural-Residential/Seven
Acre Minimum Lot Size) and the northeastern parcel will be rezoned A-Rl9A (Agricultural-
ResidentiallNine Acre Minimum Lot Size).
2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and I02.04-B of the Standard Specifications
is required.
3. That the Board of Supervisors accepts the granting of20-foot radius curves at all roadway
easement intersections. NOTE: Section 6.4-11 of the Mohave County Subdivision and
Road Maintenance Regulations states, "Road and street grades shall be limited to a
maximum of sixteen percent (16%) for paved roadways and a maximum of twelve percent
(12%) for thoroughfares and gravel roadways."
4. The roadway and utility easement access cul-de-sac will include a minimum 45-foot radius
terminus bulb.
5. All public easements granted on the Parcel Plat will be accepted by the Board of Supervisors
upon Parcel Plat recordation.
6. The roadway easement centerline will be monumented beneath the bladed road surface at all
easement angle points and coinciding parcel corners in accordance with Mohave County
Standard Specification 102.
7. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
8. Each parcel shall have legal access.
9. The Parcel Plat shall show any surface drainage and FEMA flood zones.
10. The appropriate zoning, building, environmental and floodplain permits be obtained prior
to any development. These permits will not be issued until Parcel Plat recordation. NOTE:
Due to the shallow bedrock, standard septic systems may not be acceptable to Environmental
Health or ADEQ. Alternative waste treatment systems may be required for these lots.

11. The rezone shall not become effective until at least 30 days after final Board of Supervisors
approval for the change in classification, as per ARS ll-829E.
12. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board (after notification by registered mail to the owner and
applicant who requested the rezoning) shall schedule a public hearing to grant an extension,
determine compliance with the schedule for development, or cause the property to revert to
its former zoning classification. This action is in accordance with Arizona Revised Statutes
Annotated, Title II, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, September 21, 1996, and posted September 20, 1996,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, October 7, 1996, APPROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
