WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 7, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by Steven V. and Donna K. Tadsen of Henderson, Nevada, and WHEREAS, this property is located south of Meadview on Pierce Ferry Road. The property is accessed from US Highway 93 via Pierce Ferry Road to the site, located on the east side of the road between Greentree Road and Covina Drive. The site is located approximately six miles south of Meadview Boulevard. The property is vacant and relatively flat, sloping slightly to the east. The surrounding land uses consist ofBLM land to the west and vacant land and a few scattered single-family residences to the south, east and north. No significant drainage patterns cross the property, and WHEREAS, the applicant requests this zone change to build an open and closed boat and recreational vehicle storage facility. The Mohave County General Plan designates this area as a Rural Development Area and Meadview is considered an Outlying Community, and WHEREAS, a review ofFEMA FIRM Panel #040058-1450C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 11, 1996, the Commission recommended APPROVAL for a Rezone subject to the following: J. The applicant will provide a six-foot view-obscuring fence around the open lot storage portion of this property. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 4. The applicant will obtain concurrence from the Mohave County Engineering Department regarding the method and location of accessing Pierce Ferry Road. In addition, depending upon the estimated use, the Engineering Department may require that the driveway access be paved within the Pierce Ferry Road right-of-way to prevent damage to the existing edge of pavement. 5. The applicant will obtain a right-of-way use permit from the Mohave County Engineering Department for any work within the Pierce Ferry Road right-of-way. 6. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 7. The rezone shall not become effective until at least 30 days after fmal approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 8. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 21, 1996, and posted September 20,1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
