WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 7, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by the Willow Valley Water Company, being represented by G. Kelly Grier of Burton Engineering, Inc., of Bullhead City, Arizona, and WHEREAS, this property is located south of Bullhead City, west of State Highway 95, and north of King Street. The site is accessed from State Highway 95 via west on King Street to Kingsley Street, then west-northwest on Kingsley Street to Gordon Drive, then north on Gordon Drive approximately 120 feet to the site located on the west side. The property is vacant and relatively flat. The surrounding land uses consist of the association club house and single- fmnily residences to the east. To the south and west is the proposed Willow Valley Estates, Unit 20; all the lots are vacant. There are no significant drainage patterns, and WHEREAS, the Willow Valley Estates, Unit 20, Tract 4134-A, subdivision fmal plat was recorded on August 16, 1996. Assurances were received by Mohave County to cover the cost of moving the water tank, and WHEREAS, the applicant requests this Zoning Use Permit for a 100,000-gallon water storage tank. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2606C indicates the parcel described to be in Zone B, not in the FEMA Special Flood Hazard Area, and WHEREAS, Mohave Electric Cooperative (MEC) requests that the proposed 16-foot maintenance access easement along the southern boundary of Parcel "A" be granted as an Ingress and Egress and Public Utility Easement (I&E and PUE). The applicant does not believe that the I&E and PUE is necessary as there is not a requirement for electricity at this site and it is not anticipated that it will be needed. If electricity is needed it will be the applicant's responsibility to make an agreement with MEC for power, and WHEREAS, the following described Findings of Fact are for the above captioned item: ... . . The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 11, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a 100,000-gallon water storage tank and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 3. The applicant shall provide a six-foot view-obscuring fence and landscaping around the water storage tank. 4. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 21, 1996, and posted September 20, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. on COUNTY BOARD OF SUPERVISORS
