RESOLUTION NO. 96-340 A RESOLUTION SETTING FORTH THE RESCISSION OF BOS RESOLUTION NOS. 92-97 AND 96-147 WHICH APPROVED THE REZONE AND AN EXTENSION OF TIME FOR THE REZONE FOR A PORTION OF THE Wy, EY, NEY.. SEV. OF SECTION 23, TOWNSIDP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 7, 1996, a public hearing was conducted to determine whether approval should be granted for the Rescission of the Resolutions for the Rezone and the Extension of Time for a Rezone for the above described property as requested by Smnuel D. Gallagher of Gallagher & Associates, Las Vegas, Nevada, and WHEREAS, this property is located south of Bullhead City and east of State Highway 95. The site is accessed from State Highway 95 via east on Aztec Road to the site, located approximately 300 feet west of the intersection of Aztec Road and Mountain View Road. The property is vacant and the terrain rises sharply to the northeast from the southwest comer. The surrounding land uses consist of vacant land and single-fmnily residences. The El Rodeo Channel crosses the southwestern one-quarter of the property, and WHEREAS,this property was conditionally approved for a rezone to (S-D)R-M/5A by the Mohave County Board of Supervisors on April 6, 1992, via BOS Resolution No. 92-97 to Mr. C. T. Langstraat of Bullhead City, Arizona. It was fIrst extended on May 6,1996, with BOS Resolution No. 96-147, when Mr. Langstraat decided to go forward with his project. Since this Extension of Time was granted Mr. Langstraat becmne ill and the property was acquired by Smnuel D. Gallagher of Gallagher & Associates of Las Vegas, Nevada who has decided to develop the entire EY> NEV. SEV. of Section 23. In his fax transmittal dated August 27, 1996, the property o\',ner requested that the rezoning be rescinded. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site has legal access. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 11, 1996, the Commission recommended that BOS Resolution Nos. 92-97 and 96-147 be rescinded, and . . RESOLUTION NO. 96-340 PAGE 2 OF 2 BK 2803 PG 380 FEE~9656777 Page 2 WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 21, 1996, and posted September 20, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 7, 1996, RESCINDED BOS Resolution Nos. 92-97 and 96-147 as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
