JOAN MC CALL, MOHAVE COUNTY RECORDEI 09106196 08:31A PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 MlCROALMED > ry~~ RESOLUTION NO. 96-330 A RESOLUTION SETTING FORm AN AMENDMENT TO THE MOHA VE COUNTY GENERAL PLAN, TO AMEND THE LAND-USE DESIGNATION FROM SUBURBAN DEVELOPMENT AREA TO URBAN DEVELOPMENT AREA FOR PARCELS 13-8 AND 13-9, AS SHOWN ON RECORD OF SURVEY, BOOK 11, PAGE 46, BEING A PORTION OF SECTION 13, TOWNSIDP 22 NORTH, RANGE 17 WEST, IN THE KINGMAN AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 3, 1996, a public hearing was conducted to determine whether the Mohave County General Plan should be mnended to expand the existing Urban Development Area to include the above parcels, as requested by Shawn Cmnpbell, Renzi and Cmnpbell Development of Flagstaff, Arizona, and WHEREAS, the developer proposes subdividing this property, containing 80.10 acres, into a single- family residential development with lots approximately 20,000 square feet in size. The subdivision of land into lots less than one acre in size is not consistent with the Suburban Development Area land-use designation prescribed for this property by the General Plan, and WHEREAS, the site is located approximately one and one-half miles north of the City of Kingman. The property is accessed via Stockton Hill Road, then east one-half mile on Fountain Hills Road, then north one-quarter mile, and WHEREAS, the Mohave County General Plan, approved by the Board of Supervisors on March 10, 1995, designates approximately 320 acres within Section 13 as an Urban Development Area. The first unit of Fountain Hills Estates, Tract 3050, was recorded on June 2S, 1996. Tract 3050 is located in a portion of Section 13 approved for Urban Development by the General Plan. Future units of Fountain Hills Estates are proposed by the developer of Tract 30S0, to include Parcels 13-8 and 13-9. This proposed mnendment would allow the expansion of contiguous units of low density residential development, and WHEREAS, a public meeting was held on July 15, 1996, at the Kingman cmnpus of Mohave Community College to allow discussion of the developer's proposal to mnend the Mohave County General Plan. No public input was received at that meeting. Mohave County staff has received no letters or phone calls from the public concerning this proposed mnendment, and WHEREAS, the Mohave County Public Works Department has commented, "We would like to see this request contingent upon some subdivision plan approval or a master plan submittal so we may try and insure that adequate infrastructure will be provided.", and RESOLUTION NO. 96-330 PAGE 2 OF 2 BK 2788 PG 259 FEE~9650032 Page 2 ~~"~ . . WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. This proposed action is being processed in concurrence with a similar mnendment to the Long Mountain Area Plan for the smne property. c. Section 13, Township 22 North, Range 17 West is included in the UrbanlBuilding Overlay Zone. d. The proposal is consistent with the immediately surrounding General Plan land use designation. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 14, 1996, the Commission recommended APPROVAL of this amendment to the Mohave County General Plan subject to the following conditions: 1. Parcels 13-8 and 13-9 as shown on Record of Survey, Book 11, Page 46, and located in Section 13, Township 22 North, Range 17 West, be designated as an Urban Development AreaILow Density Residential (I to 5 units per acre). 2. The concurrent mnendment to the Long Mountain Area Plan for this property be approved by the Board of Supervisors. 3. Any rezone proposed for this area be accompanied by a Preliminary Subdivision Plan. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 17, 1996, and posted on August 16, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors at their regular meeting on Tuesday, September 3, 1996, APPROVED this amendment to the Mohave County General Plan as recommended by the Mohave County Planning and Zoning Commission and outlined herein. _~C~OF SUPERVISORS Smn Standerfer, Chairm '
