RESOLUTION NO. 96-326
A RESOLUTION SETTING FORTH A REZONE OF LOTS 7,8,9 AND 10, BLOCK 138, NEW
KINGMAN ADDITION, UNIT 9, TRACT 1102, IN SECTION 29, TOWNSHIP 22 NORTH, RANGE
16 WEST, FROM C-2 (GENERAL COMMERCIAL) ZONE TO CoMO (COMMERCIAL-
MANUFACTURING/OPEN LOT STORAGE) ZONE, IN THE KINGMAN AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September
3, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the
above described property as requested by Mary C. Broska, being represented by Century 21 Barbara Ricca
Realty of Kingman, Arizona, and
WHEREAS, this property is located east of Stockton Hill Road and north of Northern Avenue
between North Bank Street and North Castle Rock Road. The site is accessed from Stockton Hill Road via
east on Northern Avenue to Butler Way, then north on Butler Way to Butler Avenue, then east on Butler
Avenue to Powell Avenue, then northeast on Powell Avenue to the site. The site is located on the southeast
side of Powell Avenue at its "T" intersection with Neal Avenue. The property is being used for open lot
storage of vehicles. The terrain is relatively flat, sloping very slightly to the southeast toward the Mohave
Wash. The surrounding land uses consist of other small businesses, single-fmnily residences and vacant lots.
The Mohave Wash Drainage Way runs along the southeast boundary of this property. There are no
significant drainage patterns that cross the property, and
WHEREAS, the applicant requests this zone change to allow open lot storage of materials and
vehicles. This is to correct a Mohave County Zoning Regulation violation. The Mohave County General
Plan designates this area as an Urban Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2165C indicates the parcel described to be
in Zone AH, in the Special Flood Hazard Area. Additional Flood Plain comments: Parcel is being
submitted to FEMA for new determination to Zone C, after the floodway construction on the Mohave Wash
Drainage Way, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above proposed action.

e. The site has legal access.
f. There are no significant environmental features affecting the site, except for the noted
Special Flood Hazard Area.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
August 14, 1996, the Commission recommended APPROVAL for a Rezone subject to the following:
1. This property will be rezoned CoMO (Commercial-Manufacturing/Open Lot Storage).
2. The applicant will provide a six-foot view-obscuring fence around the outside storage area.
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits.
4. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to construction. NOTE: Any work within the public right-of-way will require a right-
of-way permit from the Mohave County Public Works Department, attention Bassmn Elters,
P.E., Assistant County Engineer.
5. The rezone shall not become effective until at least 30 days after final approval of the change
in classification by the Board of Supervisors, as per ARS 11-829E.
6. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, August 17, 1996, and posted August 16, 1996, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
