A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF THE Wy,
SWv. NWV. OF SECTION 10, LYING WESTERLY OF US HIGHWAY 93, TOWNSHIP 16
NORTH, RANGE 13 WEST, FOR A RESIDENCE IN A C-2H (GENERAL COMMERCIAL
HIGHWAY FRONTAGE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September
3, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above described property as requested by David L. Herman of Yerington, Nevada, and Richard Johnson
of Searchlight, Nevada, and
WHEREAS, this property is located on the west side of US Highway 93, approximately three miles
north ofWikieup, Arizona. The site is accessed directly from Highway 93. The property appears to have
an old business building on it. The property is relatively flat, sloping slightly to the east. The surrounding
land uses consist of other vacant lots and a few scattered residences. There are no significant drainage
patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for a residence in conjunction with the
small business to be operated on the property by Mr. Johnson. The Mohave County General Plan designates
this area as a Rural Development Area and Wikieup is considered an Outlying Community, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2911B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
August 14, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Permit is for a residence in a C-2H (General Commercial Highway
Frontage) zone and activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits. The site plan is being accomplished with the previously approved
rezone of this property.
3. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, August 17, 1996, and posted August 16, 1996, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, September 3, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
