SWv. OF SECTION 23, LYING WESTERLY OF US HIGHWAY 93, TOWNSIDP 17 NORTH, RANGE 13 WEST, FOR A RESIDENCE IN A CoMO/SA (COMMERCIAL- MANUFACTURING/OPEN LOT STORAGEIFIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 3, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Jmnes J. Manzi of Wikieup, Arizona, and WHEREAS, this property is located west of US Highway 93, approximately nine and one-halfmiles north of the community ofWikieup. The site is accessed directly from US Highway 93. The property has a towing service and a mini-mart on the front portion of the property; the remaining portion is vacant. The surrounding land uses consist of several isolated houses and vacant land. There are no significant drainage patterns crossing the property, except for a drainage easement crossing east to west along the southem border of the property, and WHEREAS, the applicant requests this Zoning Use Permit for a residence in a C-MO/5A (Commercial-Manufacturing/Open Lot StoragelFive Acre Minimum Lot Size) zone. The Mohave County General Plan designates this area as a Rural Development Area and Wikieup is considered an Outlying Community, and WHEREAS, a review ofFEMA FIRM Panel #040058-2750B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, except for the noted Special Flood Hazard Area. ~ c . . RESOLUTION NO. 96-324 PAGE 2 OF 2 BK 2788 F'G 246 FEE~96500p~6 2 age WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 14, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: I. This Zoning Use Permit is for a residence in a C-MO/5A (Commercial-Manufacturing/Open Lot StoragelFive Acre Minimum Lot Size) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. The existing site plan as required by BOS Resolution No. 95-101, which rezoned this property, must be mnended prior to approval of permits. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 17, 1996, and posted August 16, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 3, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
