A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF THE SWv.
NEV. OF SECTION 7, TOWNSIDP 20 NORTH, RANGE 17 WEST, FOR A RESIDENCE IN A C-
MO/3A (COMMERCIAL-MANUFACTURING/OPEN LOT STORAGEITHREE ACRE MINIMUM
LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September
3, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above described property as requested by Jerry A. and Connie S. Wagner of Garden Prairie, Illinois, and
WHEREAS, this property is located south ofOatrnan Road (Old Highway 66) and west ofInterstate
40, in the McConnico area The site is accessed from Interstate 40 via west on Oatman Road to the property,
located on the south side between Morgan Drive and Kevin Drive. The property is vacant and relatively flat,
sloping slightly to the southwest. The surrounding land uses consist of the Walnut Creek Estates
Subdivision to the north and west; to the east and south are several commercial businesses and vacant land.
There are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for a residence in a C-MO/3A
(Commercial-Manufacturing/Open Lot Storage/Three Acre Minimum Lot Size) zone. This 5-acre lot will
be 400 feet wide by 544.6 feet deep, created in the northwest comer of Mohave County Assessor's Parcel
#206-13-022, dated December 5, 1995. The Mohave County General Plan designates this area as a
Suburban Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
August 14, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Permit is for a residence in a C-MO/3A (Commercial-Manufacturing/Open
Lot Storage/Three Acre Minimum Lot Size) zone and activities related thereto.
2. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
3. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, August 17, 1996, and posted August 16, 1996, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, September 3, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
