A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF THE SWv. NEV. OF
SECTION 7, TOWNSHIP 20 NORTH, RANGE 17 WEST, FROM A-R/36A (AGRICULTURAL-
RESIDENTIALITHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO C-MO/3A
(COMMERCIAL-MANUFACTURING/OPEN LOT STORAGEITHREE ACRE MINIMUM LOT
SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September
3, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the
above described property as requested by Jerry A. and Connie S. Wagner of Garden Prairie, Illinois, and
WHEREAS, this property is located south of Oatman Road (Old Highway 66) and west ofInterstate
40, in the McConnico area. The site is accessed from Interstate 40 via west on Oatman Road to the property,
located on the south side between Morgan Drive and Kevin Drive. The property is vacant and relatively flat,
sloping slightly to the southwest. The surrounding land uses consist of the Walnut Creek Estates
Subdivision to the north and west; to the east and south are several commercial businesses and vacant land.
There are no significant drainage patterns, and
WHEREAS, the applicant requests this zone change to allow for a small trucking business and a
home on five acres ofland. This lot will be 400 feet wide by 544.6 feet deep, created in the northwest comer
of Mohave County Assessor's Parcel #206-13-022, dated December 5, 1995. The Mohave County General
Plan designates this area as a Suburban Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
August 14, 1996, the Commission recommended APPROVAL for a Rezone subject to the following:
1. This property will be rezoned C-MO/3A (Commercial-Manufacturing/Open Lot Storage/
Three Acre Minimum Lot Size).
2. The residence on this property requires a Zoning Use Permit as required by Mohave County
Zoning Regulations, Section 22.1-C (Regulation for Commercial-Manufacturing/Open Lot
Storage, Uses Requiring a Zoning Use Permit).
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) to include showing the residence must
be completed and approved prior to approval of permits. A limited drainage report will have
to be submitted including a method for the on-site mitigation of any additional runoff which
will be created by this development.
4. The submittal and recordation ofa Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required.
5. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to construction. NOTE: Any work within the public right-of-way will require a right-
of-way permit from the Mohave County Public Works Department, attention Bassmn Elters,
P.E., Assistant County Engineer.
6. The rezone shall not become effective until at least 30 days after final approval of the change
in classification by the Board of Supervisors, as per ARS 11-829E.
7. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title II, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, August 17, 1996, and posted August 16, 1996, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, September 3, 1996, APPROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
