WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 4, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by E. R. Bruce, representing George Horstmyer of Great Falls, Montana, and WHEREAS, this property is located approximately 40 miles east of Kingman and north ofInterstate 40. The site is accessed from Interstate 40 via north on Fort Rock Road to Dimnond M Ranch Road, then north on DiaInond M Ranch Road approximately nine-tenths (0.9) mile to the property, located on the east side. The property is vacant and the terrain is gently rolling hills. The surrounding land uses consist of vacant land and several scattered residences. There is a gas transmission station and an electric transmission station to the south. There are several minor drainage patterns crossing the property, and WHEREAS, the applicant requests this zone change to allow development of the property. The applicant proposes to divide the 38.88-acre parcel into three 10-plus-acre parcels. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2425B indicates the parcel described to be in Zone D, not in a Special Flood Hazard Area but an area of undetermined flooding, and WHEREAS, based upon the Planning and Zoning Commission's recommendation, the Board of Supervisors denied a similar rezone in this area, and WHEREAS, this item was first heard at the Planning and Zoning Commission meeting on August 14, 1996, and was recommended for denial. At the Board of Supervisors meeting on September 3, 1996, the BOS referred this item back to the commission at the request of the applicant. Mr. Bruce believes that the commission did not adequately consider that Yavapai County allows land splits down to 2 acres and that the roads are better than the surrounding landowners have indicated, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. The proposed action and effect complies with the Mohave County General Plan. c. The site has legal access. d. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 9, 1996, the Commission recommended DENIAL for a Rezone based upon the following: I. Inadequate roadway network. 2. Incompatible with the surrounding area. 3. This rezone sets a precedent for this area. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 19, 1996, and posted October 18, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 4, 1996, DENIED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
