MICROFILMED ~ 9650021 BK 2788 PG 231 OFFICIAL RECOROS OF MOHAVE COUNTY, JOAN MC CALL, MOHAVE COUNTY RECORDE! 09/06/96 08:25A PAGE 1 OF 3 MOHAVE COUNTY BOARD DF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 96-318 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 34, LAZY YoU RANCH, PHASE I, IN SECTION 10, TOWNSIDP 20 NORTH, RANGE 16 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIALITIDRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/ 5AAND A-R/7 A (AGRICUL TURAL-RESIDENTIALIFIVE ACRE AND SEVEN ACRE MINIMUM LOT SIZE) ZONES, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. , WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 3, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by the Nash Fmnily Trust, being represented by Tyler A. Nash, Trustee, of Kingman, Arizona, and WHEREAS, this property is located southeast of the City of Kingman and south of Hualapai Mountain Road. The site is accessed from Hualapai Mountain Road via southwest on Lazy YoU Drive to Tomahawk Drive, then south on Tomahawk Drive to Surrey Drive, then west on Surrey Drive to the site at the intersection of Surrey Drive and Love Lane. The property is vacant and the terrain is hilly. The surrounding land uses consist of vacant land and a few scattered single- fmnily residences. There is a significant drainage pattern crossing the property from the southeast to the northwest, and WHEREAS, the applicant requests this zone change to allow development of the property. The applicant proposes to divide the 39.67-acre parcel into five 5-plus-acre parcels. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2350B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the Mohave County Public Works Department requests that adequate Ingress & Egress (I&E) and Utility Easements shall be provided to each parcel created, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. ... ... . . WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 14, 1996, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The three northern parcels will be rezoned A-R/5A (Agricultural-ResidentiallFive Acre Minimum Lot Size) and the two southern parcels will be rezoned A-R/7A (Agricultural- Residential/Seven Acre Minimum Lot Size). 2. The submittal and recordation ofa Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. The roadway easement centerline will be monumented beneath the bladed road surface at all easement angle points and coinciding parcel comers for existing roads Surrey Drive, Love Lane and Tomahawk Drive and the proposed 40-foot Ingress and Egress (I&E) easement. NOTE: Section 6.4-11 of the Mohave County Subdivision and Road Maintenance Regulations states, "Road and street grades shall be limited to a maximum of sixteen percent (16%) for paved roadways and a maximum of twelve percent (12%) for thoroughfares and gravel roadways." 4. Each parcel shall have legal access. 5. The grantings required by the Rezone Resolution shall be shown on the Parcel Plat. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. The Parcel Plat shall show any surface drainage and FEMA flood zones. 8. The appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. NOTE: Due to the shallow bedrock, standard septic systems may not be acceptable to Environmental Health or ADEQ. Alternative waste treatment systems may be required for these lots. 9. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E 10. If these conditions are not met within one year this approval will be void. Ifat the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. .... -# . RESOLUTION NO. 96-318 . PAGE 3 OF 3 BK 2788 PG 233 FEE~9650021 Page 2 WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 17, 1996, and posted August 16, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 3, 1996, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
