M1CROAI.MED . t'lIrnEXE1J 9650018 BK 2788 PG 224 OFFICIAL RECORDS OF MOHAVE COUNTY, I JOAN MC CALL, MOHAVE COUNTY RECORDEr 09/06/96 08:20A PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 96-315 A RESOLUTION SETTING FORTH THE RESCISSION OF BOS RESOLUTION NOS. 94-425 AND 94-426 WHICH APPROVED THE REZONE AND A ZONING USE PERMIT FOR A PORTION OF PARCEL 46, AS SHOWN ON A RECORD OF SURVEY, RECORDED AUGUST 22, 1975 IN BOOK 1, PAGE 27 AND PAGE 43, RECORDS OF MOHA VE COUNTY, IN SECTION 10, TOWNSHIP 21 NORTH, RANGE 18 WEST, IN THE GOLDEN VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 3, 1996, a public hearing was conducted to determine whether approval should be granted for the Rescission of the Resolutions for the Rezone and the Zoning Use Permit for the above described property owned by Burro Ltd., being represented by Jim Kuden of Escondido, California, and WHEREAS, this property is located on the south side of State Highway 68 between Aztec Road and Adobe Road. The site is accessed from State Highway 68 via south on Aztec Road approximately 400 feet to the site, located on the southwest comer of State Highway 68 and Aztec Road. The property has a swap meet and mini-storage on it. There is a significant drainage pattern crossing the property from the north to the south through the west side of the property. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, this property was conditionally approved for a rezone to C-217 A (General Commercial/Seven Acre Minimum Lot Size) by the Mohave County Board of Supervisors on December 5, 1994, via BOS Resolution No. 94-425. A Zoning Use Permit for the swap meet was approved on December 5, 1994, with BOS Resolution No. 94-426. Mr. Kuden was given 90 days to accomplish the Conditions of Approval for the Rezone and Zoning Use Permit from the approval date. The owner let the BOS Resolutions expire without meeting the conditions of approval. A certified letter has been sent to the owners notifying them that their approval of their rezoning has expired and an Extension of Time was required. There were no Extensions of Time requested by the property owner. Then Mr. Kuden applied for rezoning to C-2H (General Commercial Highway Frontage) and C-MO (Commercial-Manufacturing/Open Lot Storage), and a Zoning Use Permit for a swap meet and a mini-storage at the May 1996 Planning and Zoning Commission meeting. Both items were continued to the June 1996 meeting at the request of the applicant. Prior to the June 1996 meeting the applicant withdrew his application. Another letter was sent informing the property owner that it would be scheduled for rescission, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. - - . PAGE 2 OF 2 BK 2788 PG 225 FEE~9650018 . RESOLUTION NO. 96-315 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 14, 1996, the Commission recommended APPROVAL for the rescission ofBOS Resolution Nos. 94-425 and 94-426. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 17, 1996, and posted August 16, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 3, 1996, APPROVED the rescission ofBOS Resolution Nos. 94-425 and 94-426 as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
