A RESOLUTION SETTING FORTH A REZONE OF PARCELS 100-B-3A AND 100-B-3C AS
SHOWN IN THE MOHA VE COUNTY OFFICIAL RECORDS, PAGE 63, BOOK 8, RECORDED
MAY 11, 1994, IN THE SEY-a SEY-a OF SECTION 15, TOWNSHIP 21 NORTH, RANGE 18 WEST",
FROM A-R/2A (AGRICULTURAL-RESIDENTlALrrWO ACRE MINIMUM LOT SIZE) ZONE
TO A-R (AGRICUL TURAL-RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, IN THE
GOLDEN VALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November
4, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the
above described property as requested by John Dodson, representing Tamera Ann Holman of Golden Valley,
Arizona, and
WHEREAS, this property is located south of State Highway 68, between Aztec Road and Adobe
Road. The sites are accessed from State Highway 68 via south on Aztec Road to the northern site, located
on the southwest comer of Collins Drive and Aztec Road. The southern site is located approximately 400
feet south of Collins Drive on the west side of Aztec Road. Both properties are vacant, flat and sloping
slightly to the southwest. The surrounding land uses consist of single-family residences and vacant land.
There are no significant drainage patterns crossing either property, and
WHEREAS, the applicant requests this zone change to allow development of the properties. The
applicant proposes to divide the two 2-plus-acre parcels into four I-plus-acre parcels. The Mohave County
General Plan designates this area as a Suburban Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the Mohave County Public Works Department requests that an additional 5 feet
adjacent to the 20-foot Ingress and Egress (I&E) easement along the south boundary ofParceII00-B-3C,
to make a total width of 25 feet, shall be granted to the public as an Ingress and Egress (I&E) easement.
NOTE: This request will reduce the acreage to less than 2.0 net acres required, and
WHEREAS, this item was first heard at the Planning and Zoning Commission meeting on August
14, 1996, and was recommended for approval. At the Board of Supervisors meeting on September 3, 1996,
the BOS referred this item to the commission at the request of the applicant so that the commission may
consider an alternative roadway dedication, and

WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on '
October 9, 1996, the Commission recommended APPROVAL for a Rezone subject to the following:
1. These parcels will be rezoned A-R (Agricultural-Residential/One Acre Minimum Lot Size).
2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required.
3. The grantings required by the Rezone resolution shall be shown on the Parcel Plat.
4. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
5. Each parcel shall have legal access.
6. The Parcel Plat shall show any surface drainage and FEMA flood zones.
7. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to any development. These permits will not be issued until Parcel Plat recordation.
8. The rezone shall not become effective until at least 30 days after final Board of Supervisors
approval for the change in classification, as per ARS 11-829E.
9. If the required parcel plat prepared in accordance with Article 3.16 of the Mohave County
Subdivision Regulations and 102.04-B of the Standard Specifications and Details is not
recorded within one year of Board of Supervisor's approval, this rezone approval will be
void. All other conditions are to met upon the development of the property. Before the
approval is declared void the Board of Supervisors (after notification by registered mail to
the owner and applicant who requested the rezoning) shall schedule a public hearing to grant
an extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title II, Chapter 6, 11-832.

WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, October 19, 1996, and posted October 18, 1996, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, November 4, 1996, APPROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
