NE'I. NW'I. NY. OF SECTION 22, TOWNSHIP 19 NORTH, RANGE 22 WEST, FOR A WATER WELL AND A 250,000-GALLON WATER STORAGE TANK IN AN A-R (AGRICULTURAL- RESIDENTIAL) ZONE, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 3, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Gary R. Moseley, District Manager, Citizens Utilities Company of Bullhead City, Arizona, and WHEREAS, this property is located south of the City of Bullhead City, west of State Highway 95 and south of Camp Mohave Road. The site is accessed from State Highway 95 via west on Camp Mohave Road to the site located on the south side approximately three tenths (0.3) of a mile west of State Highway 95. The property is vacant and flat. The surrounding land uses consist of an existing well site adjacent to the east, and single-family residences to the north and east; the remaining property is vacant. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a water well and a 250,000-gallon water storage tank to support the new Safeway Shopping Center located on the southwest corner of State Highway 95 and Aztec Road. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2435D indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the Mohave County Public Works Department's records indicate that there is no legal access to this site, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. .. .' . RESOLUTION NO. 96-308 . PAGE 2 OF 3 BK 2788 PG 211 FEE~96S0012 Page 2 d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 14, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: I. This Zoning Use Permit is for a water well and a 250,000-gaIlon water storage tank and activities related thereto located as shown on Exhibit' A'. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 17, 1996, and posted August 16, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 3, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
