SEY.i OF SECTION 21, TOWNSHIP 14 NORTH, RANGE 20 WEST, IN THE LAKE HA V ASU CITY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 3, 1996, a public hearing was conducted to determine whether approval should be granted for a Recreational Vehicle Park Plan for the above described property in the Lake Havasu City Area as requested by Havasu Falls RV Park, Inc., being represented by William T. Miller, P.E. of Lake Havasu City, Arizona, and WHEREAS, the property is located within 300 feet of the City of Lake Havasu and adjacent to Highway 95. The vacant site is on an embankment with an RV park to the north, a residential subdivision to the west, and a commercial business, fronting Highway 95, to the south. Highway 95, bordering on the east, is the site's primary access, and WHEREAS, a review of floodplain map #040058-0200B indicates this area to be in Zone C and not in the FEMA Special Flood Hazard Area, and WHEREAS, the property owners have obtained a Zoning Use Permit in this C-2/5A zone to allow for a Recreational Vehicle Park via BOS Resolution No. 92-26 dated February 3, 1992. The size of this development is approximately 9.5 acres. The developer proposes 129 RV spaces, a manager's office and wastewater treatment plant. A club house and swimming pool are also proposed as part of a 65,000-plus square foot recreation area, and WHEREAS, water service will be provided by Havasu Water Company. Sewer will be handled through an on-site sewage treatment facility. Electric and telephone service will be provided by Citizens Utilities Rural Company, Inc. Solid waste will be compacted on site and collected by Laidlaw Disposal. Fire protection will be by the Desert Hills Fire Department, and WHEREAS, Petitions of Exception were submitted for the following: 1. Back-in RV spaces are less than 25 feet wide. Section 27.JA.b of the Mohave County Zoning Ordinance requires that back-in RV spaces be a minimum of25 feet wide. 2. Back-in RV spaces are less than 45 feet deep and pull-through RV spaces are less than 50 feet deep. Section 27.JA.b of the Mohave County Zoning Ordinance requires that back-in RV spaces be a minimum 45 feet deep and that pull-through spaces be a minimum of 50 feet deep. . . Section 27.J.4.b of the Mohave County Zoning Ordinance requires that R V spaces, for other than compact or overnight use, contain a minimum of 1,400 square feet, and WHEREAS, this Petition of Exception is submitted as a request that the Planning and Zoning Commission recommend to the Board of Supervisors the granting of these exceptions from the Mohave County Zoning Ordinance as outlined in Section 27.1.5 with the following justifications: I. Back-in RV space width less than 25 feet: A. The granting of this exception will not be detrimental to the public welfare or injurious to other adjacent properties because: . The project is self-contained and enclosed from adjacent properties by retaining walls and screen walls. The width of22 feet rather than 25 feet will not be detrimental to or impact other properties. This project as a whole should increase the value of adjacent properties. B. The request will not nullifY the intent and purpose of the Master Plan of the County or other regulations because: . No regulations regarding 500 angular spaces currently exist. The regulations found in the Zoning Ordinance are based on perpendicular RV spaces. Angular spaces require less width and turning radius than perpendicular spaces for parking recreational vehicles. C. The special circumstances or conditions affecting said property are as follows: . Angular RV spaces do not require a 25-foot width for parking. Twelve feet is provided for a concrete RV pad and ten feet for vehicle parking. This design was used on the 500-unit Boomtown RV Park in Las Vegas, Nevada, and in many other parks in the Southwest. 2. Back-in RV space depth less than 45 feet and pull-through RV 1!J)ace deoth less than 50 feet: A. The granting of this exception will not be detrimental to the public welfare or injurious to other adjacent properties because: . The project is self-contained and enclosed from adjacent properties by retaining walls and screen walls. Back-in RV space depths of 40 feet rather than 45 feet will not be detrimental to or impact other properties. Pull-through RV space depths of 45 feet rather than 50 feet will not be detrimental to or impact other properties. This project as a whole should increase the value of adjacent properties. . . No regulations regarding 500 angular spaces currently exist. The regulations found in the Zoning Ordinance are based on perpendicular RV spaces. Angular spaces require less depth and turning radius than perpendicular spaces for parking recreational vehicles. C. The special circwnstances or conditions affecting said property are as follows: . Angular RV spaces do not require 45-foot or 50-foot depths for parking. Over 50 feet of depth, measured parallel to the RV lot lines, is provided for a concrete RV pad and 19 feet for automobile parking in both instances. This design was used on the 500-unit Boomtown RV Park in Las Vegas, Nevada, and in many other parks in the Southwest. 3. RV spaces containinllless than 1.400 square feet: A. The granting of this exception will not be detrimental to the public welfare or injurious to other adjacent properties because: . The project is self-contained and enclosed from adjacent properties by retaining walls and screen walls. The proposed RV space areas of 1,148 square feet and 1,292 square feet will not be detrimental or impact other properties. This project as a whole should increase the value of adjacent properties. B. The request will not nullify the intent and purpose of the Master Plan of the County or other regulations because: . The Ordinance's existing 1,400 square foot area requirement does not conform to the existing width and depth requirements. When multiplying the minimwn width by minimwn depth, the area required would be 1,125 square feet and not 1,400 square feet. The regulations found in the Zoning manual are based on perpendicular RV spaces. Angular spaces require less width and turning radius than perpendicular spaces for parking recreational vehicles. C. The special circwnstances or conditions affecting said property are as follows: . Angular RV spaces do not require a 1,400 square foot area for parking. All notices have been advertised and posted according to regulations. b. The proposed action complies with the Mohave County General Plan and the property is designated as an Urban Development Area. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses. d. The site has legal access. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 14, 1996, the Commission recommended APPROVAL for an RV Park Plan and Petition of Exception subject to the following: I. All conditions ofBOS Resolution No. 92-26 and any amendment will be adhered to. 2. Concurrence from the Arizona Department of Transportation (ADOT) will be obtained and submitted to Mohave County regarding the method of accessing State Highway 95. 3. Arizona Department of Environmental Quality (ADEQ) approves the water supply and distribution system. 4. Arizona Department of Environmental Quality (ADEQ) approves the use and design of the sewage treatment facility for this development. 5. Plans on file in the Mohave County Planning and Zoning Department, dated July 22, 1996, are the basis of this Recreational Vehicle Park plan approval, along with the conditions set forth in these recommendations. 6. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 7. All applicable provisions of the Mohave County Zoning Regulations shall be complied with. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 17, 1996, and posted August 16, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
