JOAN MC CALL, MOHAVE COUNTY RECORDEr 09/06/96 OB'IOA PAGE I OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECDRDING FEE 0.00 RESOLUTION NO. 96-306 A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 92-26 SETTING FORTH A ZONING USE PERMIT FOR A RECREATIONAL VEHICLE PARK IN A PORTION OF THE NY, SEY4 OF SECTION 21, TOWNSHIP 14 NORTH, RANGE 20 WEST, IN THE LAKE HA V ASU CITY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 3, 1996, a public hearing was conducted to determine whether approval should be granted for an Amendment of the above described Zoning Use Permit for an RV Park in the Lake Havasu City Area as requested by Havasu Falls R.V. Park, Inc., being represented by William T. Miller, P.E. of Lake Havasu, Arizona,and WHEREAS, the property is located within 300 feet of the City of Lake Havasu and adjacent to Highway 95. The vacant site is on an embankment with an RV Park to the north, a residential subdivision to the west, and a commercial business, fronting Highway 95, to the south. Highway 95, bordering on the east, is the site's primary access, and WHEREAS, a review of floodplain map #040058-0200B indicates this area to be in Zone C and not in the FEMA Special Flood Hazard Area, and WHEREAS, the language to be added has been balded. No language has been deleted, and WHEREAS, this amendment is to clarifY that automobile parking spaces within individual RV spaces will not be required to meet Mohave County Standard Specification # 171 as implied in Condition No.9 of the Resolution. Section 27.1 of the Mohave County Zoning Ordinance does not explicitly define the minimum required surfacing material for automobile parking spaces within individual RV spaces. However, the minimum required surface material for RV pads, per Section 27.J.4.d, is gravel, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 14, 1996, the Commission recommended APPROVAL for an Amendment subject to the following: I. The applicant comply with all applicable provisions of Sections 25,26,27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27.P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. The applicant submit requisite plans and reports in accordance with Section 27.J of the Mohave County Regulations, or its successor, for review and approval by the Commission and Board of Supervisors. . . These lots will not be for sale unless or until they have been approved as subdivided parcels by Mohave County Planning and Zoning and have met all requirements of the State of Arizona. THE FOLLOWING 3 ITEMS APPLY TO ENVIRONMENTAL REQUIREMENTS. 4. Water approval as per Mohave County Zoning Regulations Section 27.J. 5. Arizona Department of Water Resources approves the quantity and quality of the water supply. 6. Arizona Department of Environmental Quality approves the use, design and installation of the sewage treatment facility for this development. THE FOLLOWING 3 ITEMS APPLY TO TRANSPORTATION RELATED REQUIREMENTS. 7. Adequate parking shaIl be implemented in accordance with the Mohave County Zoning Ordinance. 8. A one (1 ') foot vehicle non-access easement (VNE) shall be established along the east boundary of this parcel contiguous to Highway 95's west right-of-way except approved access points. This VNE shaIl be granted by separate instrument and shaIl be approved by the County Engineer. A six foot block wall shall be required along the entire boundary (Staff would consider an engineered design to assure lot protection and non-access in lieu of a block waIl). 9. The applicant shall pave all driveway access, roadways, pads and parking, except for automobile parking within RV spaces, in accordance with Mohave County Standard Specification #171, or better. Automobile parking within RV spaces shall be gravel in accordance with Mohave County Standard Specification #150, or better. TIlE FOLLOWING ITEMS APPLY TO GENERAL REQUIREMENTS. An access permit from ADOT will be required prior to approval. The appropriate zoninglbuilding/environmental permits be obtained. Appropriate signage permits be obtained. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. ... This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 15. If these conditions are not met within one (I) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. MOHA VE COUNTY BOARD OF SUPERVISORS WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 17, 1996 and posted August 16, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 3, 1996, APPROVED this Amendment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
