OF SECTION 28, TOWNSHIP 22 NORTH, RANGE 16 WEST, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO CoMO (COMMERCIAL-MANUFACTURINGI OPEN LOT STORAGE) ZONE, IN THE KINGMAN AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 4, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by Steven C. Hathaway of Lake Havasu City, Arizona, and WHEREAS, this property is located east of Stockton Hill Road and north of Northern Avenue, north of the City of Kingman. The site is accessed from Stockton Hill Road via east on Northern Avenue to Castle Rock Road, then north on Castle Rock Road to the site, located on the southeast comer of Castle Rock Road and Northfield Avenue. The property has an existing two-car garage on it and is being used by Citizens Utilities as a storage yard. The property is fenced with a chain link fence. It is relatively flat and slopes slightly to the east. The surrounding land uses consist of single-family residences to the north, south and east. There are several commercial business to the west on the north side of Northern Avenue. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for the open lot storage of construction equipment and materials, equipment rentals, and a mini-storage. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2165C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and lerrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. PAGE 2 OF 3 BK 2815 PG 850 FEE~9662029 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 9, 1996, the Commission recommended APPROVAL for a Rezone subject to the following: L 1bis parcel will be rezoned to CoMO (Commercial-Manufacturing/Open Lot Storage) zone. 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required to delineate the rezoned portion from the existing Parcel I. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. If there is any additional runoff created by this development, a Limited Drainage Report will have to be submitted to provide a method to mitigate any additional water runoff. 4. The applicant shall provide a view-obscuring fence or structure around the open lot storage portion of this development. 5. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 6. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 7. If the required parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is not recorded within one year of Board of Supervisor's approval, this rezone approval will be void. All other conditions are to met upon the development of the property. Before the approval is declared void the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 19, 1996, and posted October 18, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. ~' . . ., . PAGE 3 OF 3 BK 2815 PG 851 FEE~9662Q29 3 Page NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 4, 1996, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
