'..... 9662023 BK 2815 PG 838 OFFICIAL RECORDS OF MOHAVE COUNTY, A JOAN MC CALL, MOHAVE COUNTY RECORDER 11/07/96 01:38P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECOROING FEE 0.00 RESOLUTION NO. 96-388 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE SOUTHEASTERLY FIVE ACRES OF PARCEL 13, CEDAR HILLS RANCHES, IN SECTION 29, TOWNSHIP 21 NORTH, RANGE 14 WEST, FOR AN ABOVEGROUND WATER STORAGE TANK IN A C-2H/5A,' (GENERAL COMMERCIAL HIGHWAY FRONTAGEIFIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 4, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Robert Carlson of Thunderbolt Construction Corp of Arizona, Kingman, Arizona, representing Speedco, Inc., of Cayuga, Indiana, and WHEREAS, this property is located north of Interstate 40 and west of the Blake Ranch Road Interchange. The site is accessed from Interstate 40 via north on Blake Ranch Road to Kathy Road, then west on Kathy Road to the site, located on the southwest corner of Kathy Road and Ty Road. The property is vacant and slopes slightly to the west. The surrounding land uses consist of vacant land to the north and west, and Interstate 40 to the south. There is a truck stop with associated buildings to the east. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for an aboveground water storage tank to provide a water source for the truck lubricating center being constructed on this site. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, this property was rezoned to C-2H/5A (General Commercial Highway Frontage/Five Acre Minimum Lot Size) zone via 80S Resolution No. 95-422 on October 2,1995, and WHEREAS, a review ofFEMA FIRM Panel #040058-2375B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. d . - ~, . RESOLUTION NO. 96-388 . PAGE 2 OF 2 BK 2815 PG 839 FEE~966)023 Page 2 e. There are no significant environmental features affecting the site, except for the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 9, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for an aboveground water storage tank and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. The existing site plan per Section 27.P (Site Plan Requirements) required by BOS Resolution No. 95-422 must be amended and approved prior to approval of permits. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 19, 1996, and posted October 18, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 4, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
