SWv. NEV. OF SECTION 12, LYING EASTERLY OF THE INTERSTATE 40 RIGHT -OF- WAY LINE, TOWNSHIP 17 NORTH, RANGE 18 WEST, FOR ABOVEGROUND FUEL STORAGE TANKS IN AN A (GENERAL) ZONE, IN THE YUCCA PORTION OF THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 4, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Yucca Trading Inc., being represented by Steve Strong of Flagstaff, Arizona, and WHEREAS, this property is located east ofInterstate 40 and south of the East Yucca Interchange. The site is accessed from Interstate 40 via east at the East Yucca Interchange to the frontage road, then south on the frontage road to the site, located on the east side approximately 1,000 feet south of the interchange. The property has an existing motel on it. The surrounding land uses consist of vacant land on three sides and Interstate 40 on the west side. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for two 20,000-gallon diesel fuel tanks, one l2,000-gallon gasoline fuel tank and one 6,000-gallon gasoline fuel tank, all being aboveground for the proposed truck stop and convenience store on this property. The Mohave County General Plan designates this area as a Rural Development Area and an Outlying Community, and WHEREAS, a review ofFEMA FIRM Panel #040058-2675B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. ~ . . . . PAGE 2 OF 2 BK 2816 PG 730 FEE~9662474 RESOLUTION NO. 96-387 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 9, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for aboveground fuel storage tanks and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. The existing site plan per Section 27.P (Site Plan Requirements) must be revised to show the size and location of the fuel storage tanks completed and approved prior to approval of permits. 3. The applicant shall comply with all applicable provisions of the Office of the State Fire Marshal and the local fire department. 4. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 19, 1996, and posted October 18, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 4, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
