WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 4, 1996, a public hearing was conducted to determine whether an Extension of Time for a Specific Use Permit should be granted for the above described property as requested by Kathryn Clark of Aquarius Water Company of Parks, Arizona, and WHEREAS, this property is located south ofInterstate 40, approximately 30 miles east of the City of Kingman. The site is accessed from 1-40 via the Knight Creek Interchange, then south along an unnamed road to Knight Creek Road, then east to the site. The property is part of a 40-acre parcel containing a home and a dirt landing strip; the 3-acre parcel reserved for the bottling facility is vacant. The surrounding land uses consist of mostly vacant land and a few scattered homes. There are no significant drainage patterns. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, this Specific Use Permit was conditionally approved by the Mohave County Board of Supervisors on October 4, 1994 per BOS Resolution No. 94-354. It was extended for the first time on March 7, 1996 with BOS Resolution No. 96-92, and WHEREAS, the applicant requested in a letter dated September 4, 1996, that the Specific Use Permit be extended for one year. The letter stated "It is my intention to begin development on this project, and be well underway by the time the permit expires in October, 1997, if you would be so kind as to grant this extension," and WHEREAS, this will be the second Extension of Time for this property. The approved Extension of Time Policy allows two Extensions of Time when a developer is actively pursuing a schedule of completion, and WHEREAS, a review ofFEMA FIRM Panel #040058-2425B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: RESOLUTION NO. 96-382 Page 2 ~ . ~ . . PAGE 2 OF 2 BK 2815 PG 827 FEE~9662018 a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended. d. The site has legal access. e. There are no significant environmental features affecting the site. f. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 9, 1996, the Commission recommended APPROVAL for an Extension of Time for a Specific Use Permit subject to the following: 1. Continued compliance with the conditions ofBOS Resolution No. 94-354. 2. This Extension of Time will be in effect until October 4,1997. 3. Unless development commences before October 4, 1997, this will be the last Extension of Time. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 19, 1996, and posted October 18, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 4, 1996, APPROVED this Extension of Time for a Specific Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
