MOHAVE eOUHTY REeORDER 11/07/96 01:3~P PAGE 1 OF 2 MOHAVE eOUHTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 96-378 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE SOUTHERLY 834 FEET OF THE EASTERLY 360 FEET OF GOVERNMENT LOT 5, EXCEPT FOR THE EASTERLY 30 FEET, IN SECTION 3, TOWNSHIP 18 NORTH, RANGE 22 WEST, FOR A MOBILE HOME AND RECREATIONAL VEHICLE PARK IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 4, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by A. J. Flowers, being represented by G. Kelly Grier, Burton Engineering, Inc., of Bullhead City, Arizona, and WHEREAS, this property is located south of Bullhead City and west of State Highway 95. The site is accessed from State Highway 95 via west on Boundary Cone Road to the site, located on the north side approximately one-quarter mile west of State Highway 95. The property is vacant and relatively flat, sloping slightly to the west toward the Colorado River. The surrounding land uses consist of vacant farm land. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a mobile home and recreational vehicle park. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2445C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, Mohave Electric Cooperative (MEC) requests that the ten feet adjacent to the Boundary Cone Road right-of-way be granted as a Public Utilities Easement (PUE), and WHEREAS, the Mohave County Public Works Department states that there is no road right-of-way or easement existing for the south half of Boundary Cone Road. The developer will have to provide a total right-of-way width of 84 feet for Boundary Cone Road along this property, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 9, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a mobile home and recreational vehicle park. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.1 (Mobile Home Parks Requirements) and Section 27.1. (Recreational Vehicle Parks Requirements) must be completed and approved prior to approval of permits. A Drainage Report will have to be submitted. 3. The Board of Supervisors accepts the dedication of the 42 feet of roadway right-of-way easement known as Boundary Cone Road. 4. The ten feet adjacent to the Boundary Cone Road right-of-way shall be granted to the public as a Public Utilities Easement (PUE). 5. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 6. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 7. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 19, 1996, and posted October 18, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
