OF SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 4, 1996, a public hearing was conducted to determine whether approval should be granted for an Extension of Time as requested by G. Kelly Grier of Burton Engineering, Inc., Bullhead City, Arizona, representing the owner, for the above described Preliminary Subdivision Plan. The owner of the property is John K. Hoover, Orange, California, and WHEREAS, the subdivision is located approximately two miles south of Bullhead City. The site is accessed via State Highway 95, then east one-half mile on Aztec Road, and WHEREAS, the Revised Preliminary Plan depicts 9 acres subdivided into 36 single-family residential lots, ranging in size from 8,000 to 13,000 square feet, and WHEREAS, the engineer has indicated in a letter dated August 27, 1996, that an Extension of Time is being requested based on the following: "The owner/developer for Courtney Greens 'c' is currently negotiating for the extension of sewer service for this project. We expect to go forward with the continued processing of the Final Plat very soon...", and WHEREAS, the original Preliminary Plan for Courtney Greens, Tract 4054, was approved by the Mohave County Board of Supervisors on March 17, 1986, per P&ZC Resolution No. 86-10. The Final Plat for Tract 4054-A was recorded December 31, 1986. An Extension of Time was approved on August 6,1990, per BOS Resolution No. 90-195. The Final Plat for Tract 4054-B was recorded October I, 1990. A second extension was approved January 6, 1992, per BOS Resolution No. 92-10. The third Extension of Time for the original Preliminary Plan was approved on April 6, 1992, per BOS Resolution No. 92-105, and WHEREAS, a Revised Preliminary Plan was submitted for the unrecorded portion of Tract 4054 lying north of the El Rodeo Drainage Channel (proposed as Courtney Greens, Tract 4054-C). This Revised Preliminary Plan was approved by the Board on October 5,1992, per BOS Resolution No. 92-314. The conditional rezoning of this property, per P&ZC Resolution No. 86-1 I, was to apply to the new subdivision - -- - . . PAGE 2 OF 3 BK 2815 PG 80~ FEn9662009 RESOLUTION NO. 96-372 Page 2 proposal. The first Extension of Time for the Revised Preliminary Plan was approved by the Board on December 5,1994, per BOS Resolution No. 94-417. The second extension was approved on November 6, 1995, per BOS Resolution No. 95-448. No Final Plat has been submitted for review. Subdivision Regulation Article 3.10-1 states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (I) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated", and WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any .' additional submittals of this project for processing, the adequacy of the drainage and compatibility of this proposed subdivision with surrounding development will be reviewed, and has recommended that any required changes or modifications will be the responsibility ofthe developer, and WHEREAS, the following are Findings of Fact for the above captioned item: WHEREAS, this will be the third Extension of Time of the latest approved Preliminary Plan for the subdivision, and a. All notices have been advertised and posted according to regulations. b. The proposed action complies with the Mohave County General Plan, and the property is designated as an Urban Development Area. c. The site is adequate for the action intended and the proposal is consistent with the surrounding land uses. d. This request does not comply with the Extension of Time Policy. WHEREAS, staff originally recommended the denial of this request for an Extension of Time due to the lack of compliance with the Subdivision Regulations and with the Extension of Time Policy, and WHEREAS, at the Planning and Zoning Commission meeting on October 9, 1996, a representative of the engineering firm for the project proposed the submittal of a new Preliminary Plan. The developer intends to have the project served by a central sewer system. The currently approved Preliminary Plan was designed to be served by individual septic systems, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 9, 1996, the Commission recommended APPROVAL of an Extension of Time for the existing Revised Preliminary Plan subject to the following conditions: 1. Compliance with all conditions ofBOS Resolution Nos. 92-314, 94-417, and 95-448. 2. Unless significant progress is made in the coming year toward the recordation of this project, Planning staff will recommend denial of any additional Extensions of Time for this Preliminary Plan. . . The project engineer may submit a new Preliminary Plan for review by staff. Staff will review the submittal for compliance with the Subdivision Regulations, and will present a recommendation to the Planning and Zoning Commission if the Preliminary Plan achieves compliance with the regulations. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 19,1996, and posted on October 18,1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors at their regular meeting on Monday, November 4,1996, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
