RESOLUTION NO. 96-368 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THAT PORTION OF GOVERNMENT LOT 4 LYING BETWEEN INTERSTATE 15 AND OLD HIGHWAY 91, IN SECTION 32, TOWNSHIP 40 NORTH, RANGE 16 WEST, FOR A RESIDENCE IN A C-2 (GENERAL COMMERCIAL) ZONE, IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 4, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Joseph V. Hamilton of Mesquite, Nevada, and WHEREAS, this property is located between Interstate 15 and County Highway 91 east of the Arizona/Nevada state line. The site is accessed from County Highway 91 directly to the north. The property is vacant and is abandoned State right-of-way and slopes slightly to the south. The surrounding land uses consist ofInterstate 15 to the north, Nevada and the City of Mesquite to the west, vacant land to the east and the Fairview Mobile Home Estates to the south. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a residence in a C-2 (General Commercial) zone. The Mohave County General Plan designates this area as Rural Development Area and an Outlying Community, and WHEREAS, a review of FEMA FIRM Panel #040058-0200B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 9, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: - RESOLUTION NO. 96-368 Page 2 ~ . . . PAGE 2 OF 2 BK 2815 PG 796 FEE~9662005 1. This Zoning Use Permit is for a residence in a C-2 (General Commercial) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) required by BOS Resolution No. 96-74 for the rezone must show the residence, and must be completed and approved prior to approval of permits. 3. The applicant will pave driveway entrances from the edge of pavement of County Highway 91 to the property line to protect the edge of pavement. Prior to any work within the public.. right-of-way a permit will have to be obtained from the Mohave County Public Works Department of Engineering, attention Sam Elters. 4. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 19, 1996, and posted October 18, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
