RESOLUTION NO. 96-367
A RESOLUTION SETTING FORTH A SPECIFIC USE PERMIT ON BLOCKS 43, 44, 45, 52, 53,
54, 75, 76 AND 77, VIRGIN ACRES TRACT NO 1, IN SECTION 29, TOWNSHIP 41 NORTH,
RANGE 15 WEST, FOR A SEWAGE LAGOON IN A M-X (REA VY MANUFACTURING) ZONE,
IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December
2, 1996, a public hearing was conducted to determine whether a Specific Use Permit should be granted for
the above described property as requested by Biasi Ranch Partnership being represented by Gary Biasi,
General Partner, of Mesquite, Nevada, and
WHEREAS, this property is located west of County Highway 91 and north of the Interstate 15 and
County Highway 91 interchange in the Littlefield area. The site is accessed from County Highway 91 via
west on Biasi Ranch Road to the site, located approximately one mile west of County Highway 91. The
property is vacant and relatively flat. The surrounding land uses consist of vacant land and several single-
family residences. There are no significant drainage patterns, and
WHEREAS, the applicant requests this Specific Use Permit to allow for a sewage lagoon in a M-X
(Heavy Manufacturing) zone. The Mohave County General Plan designates this area as a Rural
Development Area and an Outlying Community, and
WHEREAS, a review ofFEMA FIRM Panel #040058-0025B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
October 9, 1996, the Commission recommended APPROVAL for a Specific Use Permit subject to the
following:

1. This Specific Use Permit is intended for a sewage lagoon in a M-X (Heavy Manufacturing)
zone, and activities related thereto; any new use will require another Specific Use Permit.
2. The Specific Use Permit will commence upon the effective date of the rezone.
3. The applicant will comply with all Arizona Department of Environmental Quality (ADEQ)
requirements.
4. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits.
5. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to construction.
6. Approval of a Specific Use Permit with such conditions and restrictions as the Board of
Supervisors may impose, shall be valid for two (2) years, in which time construction on the
project shall commence or the use authorized shall be initiated. Prior to expiration of the
approval, the developer may request an Extension of Time from the Commission to initiate
the project, and the Commission shall recommend to the Board an action based upon a
finding of substantial grounds of which to grant such an Extension of Time up to one (I)
year.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, October 19 and November 16 1996, and posted October
18 and November IS, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning
Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, December 2, 1996, APPROVED this Specific Use Permit as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
