RESOLUTION NO. 96-430
A RESOLUTION SETTING FORTH AN ABANDONMENT OF THE 42-FOOT ROAD AND
PUBLIC UTILITY EASEMENTS ADJACENT TO PARCELS 13-4 AND 13-5, AND THE 60-FOOT
ROAD AND PUBLIC UTILITY EASEMENT BETWEEN PARCELS 13-4 AND 13-5 AS SHOWN
IN RECORDS OF SURVEY BOOK 8, PAGE 51, IN SECTION 13, TOWNSHIP 19 NORTH,
RANGE 19 WEST, IN THE OATMAN PORTION OF THE MOHAVE COUNTY GENERAL
AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 10,
1997, a public hearing was conducted to determine whether approval should be given for an abandonment
of a 60-foot and 42-foot road and public utility easement as requested by the Department of the Interior,
Bureau of Land Management, Kingman, Arizona, and
WHEREAS, the site is in the southern part of Golden Valley, south of Oatman Road. Access to the
site is from Oatman Road south on Garnet Road. The site is approximately three-quarters of a mile south
of Oatman Road. The road and public utility easements to be abandoned are currently unoccupied and
unimproved. The site is relatively flat, sloping slightly to the east toward the Sacramento Wash. Meadow
Creek (dry) traverses the northern portion of both parcels, and
WHEREAS, this item was first presented to the Planning and Zoning Commission on November
13, 1996, where it was denied by a 4-2 vote. The Board of Supervisors (BOS) continued the item at their
December 2, 1996, meeting. On January 6,1997, the BOS referred the item to Planning and Zoning staff
for further review, and
WHEREAS, Mr. Kuden, the original applicant, has sold these parcels to the Salt River Project
(SRP) who in turn has compensated the Bureau of Land Management (BLM) for the loss of quality desert
tortoise habitats caused by the construction of the Department of Energy's Mead-Phoenix SOO kV
Transmission Line Project for the SRP. In a letter to the Board of Supervisors dated September 19, 1996,
Mr. John R. Christensen of the BLM states that "since the lands are being acquired for the promotion of
natural resource conservation, the easements would not be necessary as the two parcels would remain
undeveloped under BLM management," and
WHEREAS, the Department of Public Works is opposed to any roadway abandonment that would
deny or reduce access to adjacent, privately owned land, and
WHEREAS, Citizens Utilities Rural Company, Inc., is opposed to the loss of public utility
easements along Section lines, in general, and

WHEREAS, a review ofFEMA FIRM Panel #0400S8-2S00B indicates the land described to be in
Zone A, a FEMA Special Flood Hazard Area, and
WHEREAS, following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The property is designated as a Rural Development Area.
c. The proposed action is not in conformance with GoalSI ofMohave County's General Plan
regarding the maintenance of an adequate transportation network.
d. The proposed action is in conformance with Goal S of Mohave County's General Plan
regarding proactive environmental management for endangered species.
e. The proposed Abandonment will deny legal access to private land holdings in Section 23 and
deny these privately owned parcels from receiving public utility service.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
February 12, 1997, the Commission recommended APPROVAL for an Abandonment subject to the
following:
1. The 42-foot road and public utility easement along the western edge of Parcel 13-4 known
as Garnet Road be retained and not abandoned.
2. The 42-foot road and public utility easement along the southern edge of Parcels 13-4 and 13-
5 known as Sonoita Drive be retained and not abandoned.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, February 22, 1997, and March 1, 1997, and posted
February 21,1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, March 10, 1997, APPROVED this Abandonment as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
