WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 2, 1996, a public hearing was conducted to determine whether an Amendment to BOS Resolution No. 96- 314, setting forth a Zoning Use Permit, should be granted for the above described property as requested by Karen McDaniel, doing business as K & K Enterprises of Golden Valley, Arizona, and WHEREAS, the language to be added has been bolded. The language to be deleted has been strttek, and WHEREAS, this property is located on the S6trth north side of State Highway 68, between Hope Road and Higley Road. The site is accessed directly from State Highway 68. The southern portion of the property is vacant, with several small commercial businesses on the northern portion. The property is flat, sloping slightly to the south. The surrounding land uses consist of vacant land, several single-family residences, an RV park to the west, and a church on the south side of Stale Highway 68. There are no significant drainage patterns, and WHEREAS, the applicant requests lhis Zoning Use Permit for a swap meet in a C-2H11A (General Commercial Highway Frontage/One Acre Minimum Lot Size) zone. The Mohave County General Plan designales this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described 10 be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the applicant requests that the entrance from State Highway 68 and the parking lot be paved with crushed rock instead of the Mohave County Standard Specification No. 173 (chip seal), and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan and the Golden Valley Area Plan. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 13, 1996, the Commission recommended APPROVAL for an Amendment to BOS Resolution No. 96-314, setting forth a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a swap meet in a C-2H/IA (General Commercial Highway Frontage/One Acre Minimum Lot Size) zone and activities related thereto. 2. The el'ltl'ltilce ff6m Stftte IIigh"a) 68 llftd the parking lot shall be paved improved to the Mohave County Standards Specifications 11173 (ehip ~eal) (Draft) for "Gravel surface Course for Parking Lots" or better. 3. The entrance from State Highway 68 shall meet Arizona Department of Transportation (ADOT) standards. 3:- 4. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. A limited drainage report will have to be submitted including a method for the on-site mitigation of any additional runoff which will be created by this development. 4: 5. The Arizona Department of Transportation (ADOT) should be consulted for the method of accessing State Highway 68. 5;- 6. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 6-: 7. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 16,1996, and posted November 15, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. . . PAGE 3 OF 3 5 BK 2830 PG 518 FEE~96682. 9 .' h RESOLUTION NO. 96-418 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 2, 1996, APPROVED this Amendment to BOS Resolution No. 96-314, setting forth a Zoning Use Permit, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
