CALL, MOHAVE COUNTY RECORDEI 12/12/96 10:07A PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 96-413 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED PRELIMINARY SUBDIVISION PLAN OF ROYAL ESTATES, TRACT 3302, BEING A SUBDIVISION OF A PORTION OF THE SW'I. SW'I. OF SECTION 10, TOWNSHIP 21 NORTH, RANGE 19 WEST, IN THE GOLDEN VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 2, 1996, a public hearing was conducted to determine whether an Extension of Time of the Preliminary Subdivision Plan for the above described property should be granted, as requested by Jesus G. Reyes, GV Development, Inc. The owner of the property is Judy Hagerty for Royal Estates, Inc., Bullhead City, Arizona, and WHEREAS, the subdivision is located approximately 10 miles west of the intersection of US Highway 93 and State Highway 68, on the northeast corner ofEgar Road and Shipp Drive in Golden Valley, Arizona. The site is accessed via State Highway 68 to Egar Road, then south on Egar Road to the site, located on the northeast comer ofEgar Road and Shipp Drive, and WHEREAS, Ihe Preliminary Plan depicls 40.04 gross acres subdivided into 123 single family residential lots, ranging in size from 8,000 to 12,000 square feet. The tract also includes three drainage parcels; a parcel reserved for a wastewater treatment plant, consisting of approximately 1.6 acres; and an approximately 15,000-square-foot parcel reserved for a neighborhood park, and WHEREAS, the agent for the developer has indicated in a letter dated September 9,1996, that an Extension of Time is being requested based on the following: "At present we are trying to evaluate our options on how to proceed wilh our project," and WHEREAS, the Preliminary Plan and Pelition of Exception for Royal Estates, Tract 3302, was approved by the Mohave County Board of Supervisors on November 3,1994, per BOS Resolution No. 94- 391. This property was granted conditional rezoning on November 3,1994, per BOS resolution No. 94- 390. No Final Plat has been submitted for review. Subdivision Regulation 3.10-1 states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (I) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated," and WHEREAS, the Mohave County Department of Public Works recommends that this request be approved conditional to the understanding thai, upon receipt of any additional submittals for processing, the adequacy of the drainage and compatibility of this proposed subdivision with surrounding development will be reviewed and any required changes or modifications will be the responsibility of the developer, and RESOLUTION NO. 96-413 Page 2 ... ., ~ .... . . PAGE 2 OF 2 BK 2830 PG 505 FEE~966825~ WHEREAS, this will be the first Extension of Time, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action complies with the Mohave County General Plan, and the property is located in an Urban Development Area. c. The site is adequate for the action intended and the proposal is consistent with the surrounding land uses. d. There has been no activity on the subdivision for nearly two years. Improvement plans have not been submitted or approved for this subdivision in the past twelve months. Mohave County has no record that any improvements have been completed, and the applicant has provided no evidence that approvals from local, state, and/or federal agencies are being pu,rsued. No Final Plat has been submitted and no phase of this subdivision has been recorded. e. This request does not comply with the approved Extension of Time policy because the developer has not actively processed the Final Plat. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 13, 1996, the Commission recommended APPROVAL for an Extension of Time subject to the following: 1. Compliance with all conditions ofBOS Resolution Nos. 94-390 and 94-391. 2. Unless significant progress is made in the coming year toward the recordation of this project, Planning staff will recommend denial of any additional Extensions of Time for this Preliminary Plan. 3. This Extension of Time will be in effect until November 3,1997. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 16, 1996, and posted November 15, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
