MOHAVE COUNTY RECORDEI 12/12/96 10:05A PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 96-410 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOTS 7 AND 10, TOPOCK LAKE RANCHEROS, TRACT 1037, IN SECTION 17, TOWNSHIP 17 NORTH, RANGE 21 WEST, FOR A HORSE BREEDING, TRAINING FACILITY AND RIDING STABLE IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 2, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Lorelei Tuss of Mohave Valley, Arizona, and WHEREAS, this property is located east of State Highway 95, south of Courtwright Road, south of Bullhead City. The site is accessed from Courtwright Road via south on Ranchero Lane to Old West Drive, then east on Old West Drive to the site, located on both sides of Old West Drive at the end of the cul- de-sac. Lot 7 has a single-family residence on it along with several horse corrals and a riding slable. Lot 10 has a single-family residence on it. The surrounding land uses consist of vacant lots and several single- family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a horse breeding, training facility and riding stable. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2620C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, Mohave County Public Works Departmenl requests that a Site Plan in accordance with Section 27.P of the Mohave County Zoning Regulations will have to be submitted. In addition, if this development creates any additional impervious area a Limited Drainage Report will have to be submitted. The Planning and Zoning Department does not believe that this is required for a horse breeding, training facility and riding stable, and WHEREAS, the following described Findings of Fact are for the above captioned ilem: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. RESOLUTION NO. 96-410 Page 2 .. .-......... . . PAGE 2 OF 2 BK 2830 PG ~99 FEE~9668251 d. The site has legal access. e. There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 13, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a horse breeding, training facility and riding stable and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. 1bis Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 16,1996, and posted November 15, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 2,1996, APPROVED this Zoning Use Permit as recommended by the Mohave Counly Planning and Zoning Commission and outlined herein.
