A RESOLUTION SETTING FORTH A PRELIMINARY SUBDIVISION PLAN AND PETITION
OF EXCEPTION FOR DESERT LAKES GOLF COURSE AND ESTATES, UNIT H, TRACT 4159,
BEING A SUBDIVISION OF LOT 4, MOHA VE MESA ACRES, TRACT 1020, A PORTION OF
SECTION 35, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHA VE VALLEY
AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December
2, 1996, a public hearing was conducted to determine whether approval should be granted for a Preliminary
Subdivision Plan and Petition of Exception for the above described subdivision, as requested by the
owner/developer, Dewey Davide, of Fort Mojave, Arizona, and
WHEREAS, Stadler Consulting Engineers of Phoenix, Arizona, is the engineering firm of record,
and
WHEREAS, the property is located approximately three miles south of Bullhead City. The land
is accessed via State Highway 95, then east one-half mile on Joy Lane, then south one-quarter mile along
and east of Tableau Drive to the site, and
WHEREAS, the Preliminary Plan depicts 2.18 acres subdivided into six single-family residential
lots. One 101 contains an existing home and includes more than an acre. The remaining five lots include
slightly more than 7,000 square feet each, and
WHEREAS, the property was conditionally rezoned on June 3, 1996, per BOS Resolution No. 96-
187 to accommodate the size of the lots and the uses proposed on the Preliminary Plan for the subdivision,
and
WHEREAS, services for the subdivision will be provided by the following: electric and telephone
service will be provided by Mohave Electric Cooperative and Citizens Utilities Company, respectively;
central water will be provided by Bermuda Water Company; central sewage disposal will be provided by
Sorenson Utility Company; solid waste (garbage) disposal will be provided by Tri-State Refuse Disposal;
natural gas will be served by Southwest Gas Corporation; and the subdivision will receive fire protection
from the Fort Mojave Mesa Fire Departmenl, and
WHEREAS, the abandonment of a portion of an existing non-vehicular access easement located
along the eastern boundary of this subdivision is being processed separately and concurrently, and

WHEREAS, Petitions of Exception were submitted for the following deficiencies:
1. Ten-foot front yard Public Utility Easements, and substandard width six-foot combined
utility and drainage easement, instead of 16-foot rear yard Public Utility Easements. The
request for the lO-foot PUEs is for the entire subdivision. The 6-foot PUEIDE will be
localed along the north boundary of the tract Section 6.9 of the Mohave County Subdivision
Regulations requires that easements at least 16 feet in total width be provided along rear lot
lines.
2. Block length shorter than 500 feet in length. 1bis request is for the only block in the
subdivision. Section 6.6-I-A of the Mohave County Subdivision Regulations requires that
blocks shall not be less than 500 feet in length.
WHEREAS, these petitions are submitted as exceptions from the Mohave County Subdivision
Regulations as outlined in Article 1.13, and based on the justification that the above noted petitions of
exception are not detrimental to the public welfare or injurious to other adjacent properties, nor does the
request nullify the intent of the Master Plan of the county or other regulations, and
1. The approval of this subdivision is based on the understanding by the Planning Commission
and the Board of Supervisors that all grading and drainage related improvements will be
made as recommended by the design engineer in the submitted drainage reports and as
approved by the County Engineer. All lots and road centerline monuments will be staked
and monumented in accordance with Mohave County Standard Specification No. 102. Road
name and regulator signs will be installed in accordance with the requirements of the
Mohave County Subdivision Regulations and as recommended by the design engineer. As
a condition of approval, the owner/subdivider is responsible for tbe completion of these
site improvements and shall provide an assurance for all required subdivision
improvements in accordance with Article V of the Mohave County Subdivision
Regulations.
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The property is designated as an Urban Development Area, and the proposed action complies
with the Mohave County General Plan, as designated therein.
c. The site appears to be adequate for the action intended. The use is consistent with the
surrounding land uses.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
November 13, 1996, the Commission recommended APPROVAL of the Preliminary Subdivision Plan and
Petition of Exception, subject to the following conditions:

2. A property owners association or other entity shall be formed for this project to provide
perpetual maintenance for any common areas or any other facility deemed to be under the
joint ownership of the lot owners, as detailed in the CC&Rs. Moreover, the articles of
incorporation forming a property owners association shall be submitted as per Mohave
County Subdivision Regulations.
3. The Arizona Department of Environmental Quality approves the sanitary facilities for this
subdivision, including the source of water supply and the method of sewage disposal, prior
to the recordalion of the Final Plat.
MOHA VE COUNTY BOARD OF SUPERVISORS
4. The Arizona Department of Water Resources determines that there is an adequate water
supply to serve this subdivision, prior to the recordation of the Final Plat.
5. Signed and ratified service contracts from the purveyors of all utilities and other services to
the subdivision must be submitted to Planning and Zoning prior to the recordation of the
Final Plat.
6. Lots within the recorded Final Plat of this subdivision will not be further divided.
7. 1bis conditional approval for the subdivision is based on the Preliminary Plan submitted for
review on September 27, 1996.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, November 16, 1996, and posted on November 15, 1996,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, December 2, 1996, APPROVED this Preliminary Subdivision Plan and Petition of Exception
as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
