MlCRORLMID fNIJEXED 9668244 BK 2830 PG ~80 OFFICIAL RECORDS OF MOHAVE COUNTY, A .JOAN MC CALL, MOHAVE COUNTY RECORDEfi 12/12/96 09:57A PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 96-403 A RESOLUTION SETIING FORTH THE RESCISSION OF BOS RESOLUTION NOS. 94-34 AND 94-215, WHICH APPROVED THE PRELIMINARY SUBDIVISION PLAN, PETITION OF EXCEPTION, AND THE AMENDMENT CORRECTING THE LEGAL DESCRIPTION OF THE SUBDIVISION FOR BEAVER DAM HEIGHTS, TRACT 3503, BEING A SUBDIVISION OF A PORTION OF SECTION 33, TOWNSHIP 41 NORTH, RANGE 15 WEST, IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 2, 1996, a public hearing was conducted to determine whether Beaver Dam Heights, Tract 3503, should be rescinded as requested by Mohave Engineering Associates, the new projecl engineer and authorized agent for the new owners. The new owners of the property are James Martin and Kathryn Price, M&P Homes of Mesquite, Nevada, and WHEREAS, the proposed Beaver Dam Heights is located approximately one and one-half miles north of the County Highway 91 interchange with Interstate 15, north of the outlying community of Beaver Dam!Littlefield. The site is accessed via Interstate 15, then north along and west of County Highway 91, and WHEREAS, the Preliminary Plan for Tract 3503, first submitted in December, 1992, depicted 14.11 acres subdivided into 14 single-family residential lots, ranging in size from one acre to 1.2 acres. The Preliminary Plan for Tract 3503 was conditionally approved on February 1, 1994, per BOS Resolution No. 94-34. No Final Pial was submitted for review. Ownership and engineering changed, and the new developers proposed a significanl increase in the density of the subdivision. A new Skelch Plan was required by the Subdivision Regulations due 10 the major revision proposed. Tracl number 3506 was assigned to the project upon approval of the Sketch Plan, and WHEREAS, the new Preliminary Plan for Beaver Dam Heights, Tract 3506, was submitted in September, 1996. The new Preliminary Plan depicts 19.29 acres subdivided into 77 single-family residential lots, one landscaping parcel, one drainage parcel, and two parcels designed for sewage treatment facilities and easemenls. A rescission of the previous approvals for Tract 3503 is necessary, as the approvals for Tract 3503 do not reflect or allow for the changes made by the applicant, as shown on the new Preliminary Plan for Tract 3506. The Preliminary Plan for Tract 3506 will be scheduled for consideration by the Planning and Zoning Commission and the Board of Supervisors when it has reached compliance with the Mohave County Subdivision Regulations. The accompanying rezoning of this property will be processed concurrently with the consideration oflhe Preliminary Plan, and . , 0 . . All notices have been advertised and posted according to regulations. b. The Final Plat for Tract 3503 was not actively processed. c. The resolutions approving Tract 3503 are obsolete, and do not correspond to the developer's new proposal for Beaver Dam Heights. MOHA VE COUNTY BOARD OF SUPERVISORS WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 13, 1996, the Commission recommended APPROVAL of an unconditional rescission ofBOS Resolution Nos. 94-34 and 94-215. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 16, 1996, and posted on November 15, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors at their regular meeting on Monday, December 2,1996, APPROVED the rescission ofBOS Resolution Nos. 94-34 and 94-215, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
