A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 96-274,
SETTING FORTH A ZONING USE PERMIT ON LOT 4, BLOCK 221 AND LOT 1, BLOCK 222,
VIRGIN ACRES, TRACT NO.1, IN SECTION 32, TOWNSHIP 41 NORTH, RANGE 15 WEST,
FOR A WELL PUMP SITE, WATER STORAGE TANK, A RADIO COMMUNICATIONS TOWER
(NOT TO EXCEED 100 FEET), A RADIO EQUIPMENT SHELTER AND RELATED ITEMS, IN AN
A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE ARIZONA STRIP AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December
2, 1996, a public hearing was conducted to delermine whether an Amendment to BOS Resolution No. 96-
274, setting forth a Zoning Use Permit, should be granted for the above described property as requested by
the Beaver Dam Water Company, being represented by Bob Frisby, President, of Beaver Dam, Arizona, and
WHEREAS, the language to be added has been bolded and italicized. Language to be deleted has
been stmek, and
WHERE~S, this property is located west ofYS Mohave County Highway 91 and northwest of the
Littlefield Interchange, in the Littlefield Beaver Dam area. The site is accessed from Highway 91 via west
on a local road known as "Old Pioneer Road" to the southern boundary of Section 32, then west on a public
road not named in Virgin Acres approximately one-half mile to the site on the north side. The property is
vacant and flat, sloping slightly to the east. The surrounding land uses consist of vacant land and a few
single-family residences. There are no significant drainage patterns crossing the property, and
WHEREAS, the applicant requests this Amendment to BOS Resolution No. 96-274, which
approved a Zoning Use Permit to allow for an existing well pump site, water storage tank and related items,
for the construction of a radio communications tower (not to exceed 100 feet) to accommodate the Beaver
Dam Water Company and other users, along with a shelter to protect the radio equipment The Mohave
County General Plan designates this area as a Rural Development Area and an Outlying community, and
WHEREAS, a review ofFEMA FIRM Panel #040058-0025B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.

c. The site is adequate for the action intended.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
November 13, 1996, the Commission recommended APPROVAL for an Amendment to BOS Resolution
No. 96-274 setting forth a Zoning Use Permit subject to the following:
I. 1bis Zoning Use Permit is for a well pump site, a total of five water storage tanks, a radio
communications tower (not to exceed lOOfeet), a radio equipment shelter, related items
and activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations.
3. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety and welfare.
6. The applicant shall obtain an approval 10 construct and an approval of construction from the
Arizona Department of Environmental Quality (ADEQ).
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, November 16, 1996, and posted November 15, 1996, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW T~EREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, December 2, 1996, APPROVED this Amendment to BOS Resolution No. 96-274 setting forth
a Zonin~,~\l;i~xmit as recommended by the Mohave County Planning and Zoning Commission and
