OF SECfION 18, TOWNSHIP 41 NORTH, RANGE 6 WEST, TO BE KNOWN AND SUBDIVIDED AS CENTENNIAL PARK, UNIT 1, TRACT 3505, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO C-l (NEIGHBORHOOD COMMERCIAL), R-l (SINGLE FAMILY RESIDENTIAL) AND N-P (NEIGHBORHOOD PARK) ZONES, IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 2, 1996, a public hearing was conducted to determine whether an Amendment to BOS Resolution No. 95- 443, setting forth a Rezone for the above described subdivision, should be granted for the above described property as requested by John Timpson, President, Basic Development Corp. of Colorado City, Arizona, and WHEREAS, the language to be added has been bolded, and language to be deleted has been mrttek, and WHEREAS, the property is located south of Arizona Highway 389 and east of Berry Knoll Street The subdivision is accessed from Highway 389 via Berry Knoll Street, then south to the site. The Mohave County General Plan designates this as a Rural Development Area and an Outlying Community, and WHEREAS, the surrounding land uses consist primarily of vacant land. The Town of Colorado City is located to the north with the cily's airport to the west There are a number of homes located on the site and three commercial buildings on the easl side of the site adjacent to Berry Knoll Street This subdivision will clear the zoning violation on the property and allow each landowner a separate deed to their property. The owners/developers of the subdivision also own the land to the south and west and plan to develop that portion of the site into single-family lots, and WHEREAS, the zone change is proposed in connection with Centennial Park Subdivision. The subdivision plan depicts 90-plus-acres subdivided into 63 single-family residential lots, two commercial parcels and one parcel designated as a neighborhood park. The minimum single-family residential lot size will be 33,835 30,035 square feet, with an average lot size of 44,000 square feet. The common area will consist of H approximately 2.05-acres, and WHEREAS, the lot on the northeast side of the subdivision was previously zoned CM (Commercial Manufacturing), and a number of the residential lots will retain their current zoning of A-R (Agricultural- Residential), and ~~' . . PAGE 2 OF ~ BK 2830 PG 475 FEE~9668242 RESOLUTION NO. 96-401 Page 2 WHEREAS, the applicant requests this Amendment to BOS Resolution No. 95-443, approving a Rezone to change the size of Lot GM-l, Block A, the size of Lot pol, Block A, and the size of Lots I thru 7, Block A, and WHEREAS, a review ofFEMA FIRM Panel #040058-0005A indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, except for a portion of the SEv.. which is in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. c. The site has legal access. d. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 13, 1996, the Commission recommended APPROVAL for an Amendment to BOS Resolution No. 95-443 setting forth a Rf''7n'!e subject to the following: 1. The lots will be zoned as follows and as shown on Exhibit "A": a. R-l/20M (Single-Family Residentia1lTwenty Thousand Square Foot Minimum Lot Size) . Lots 1-12, BlockA. . Lots 1-13, Block B. b. Lot P-I, Block A. e. A-R (Agricultural-Residential) . Lots 13-27, Block A. . Lots 1-10 and Lots 12-23, Block C. f. CoM (Commercial-Manufacturing) . The appropriate zoning, building, environmental, and floodplain permits be obtained for all new construction. 3. The rezone will become effective upon recordation of the Final Plat for Centennial Park, Unit I, Tract 3505. If the development is phased, the zoning for the recorded phase only will become effective or the rezone shall not become effective until at least 30 days after fmal approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 4. The lot size minimum will be based on the size of the lots recorded on the Final Plat with no further lot splits. ~~~L Sam Standerfer, Ch . WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 16,1996, and posted November 15,1996, as required by ArizQna Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 2, 1996, APPROVED this Amendment to BOS Resolution No. 95443 setting forth a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
