RESOLUTION NO. 97-101
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE SOUTH 144.3 FEET OF
LOT 5, MOHAYE MESA ACRES, TRACT 1020, IN SECTION 35, TOWNSHIP 19 NORTH,
RANGE 22 WEST, FOR A SECONDARY RESIDENCE IN AN A-R (AGRICULTURAL-
RESIDENTIAL) ZONE, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 7,
1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above described property as requested by David V. and Rosemary Gutowski of Bullhead City, Arizona, and
WHEREAS, this property is located south of Bullhead City, east of State Highway 95 between Joy
Lane and Lipan Boulevard. The site is accessed from State Highway 95 via east on Joy Lane to Tableau
Drive, then south on Tableau Drive to the site, located on the east side approximately 175 feet south of the
intersection of Tableau Drive and Chaparral Road. The property has a single-family residence with a
detached garage on it. The surrounding land uses consist of single-family residences and vacant lots. There
are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit to allow an eight-foot by thirty-six-foot
(8' x 36') travel trailer to be used as a secondary residence in an A-R (Agricultural-Residential) zone for
family members. The Mohave County General Plan designates this area as an Urban Development Area,
and
WHEREAS, a review ofFEMA FIRM Panel #040058-2445C indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site, except for the noted
Special Flood Hazard Area.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 12, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
I. This Zoning Use Permit is for a travel trailer to be used as a secondary residence on this
property and the activities related thereto. The travel trailer shall have a living room of not
less than 220 square feet of superficial floor area.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.R (Accessory or Secondary Residence Requirements) and a site
plan in accordance with Section 27.R must be completed and approved prior to approval of
permits.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors, if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
6. This Zoning Use Permit is approved for one year and expires April 7, 1998. Travel Trailers
allowed as secondary residences shall be approved by the Board of Supervisors in one-year
increments following a recommendation from the Planning and Zoning Commission. An
application for an Extension of Time must be applied for.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 22, 1997, and March 21, 1997, as required by
Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 7, 1997, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning ann zoning Commission and outlined herein.
