OF SECTION 31, TOWNSHIP 15 NORTH, RANGE 17 WEST, FROM A-R/36A (AGRICUL TURAL-RESIDENTIALffHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO M-X (HEAVY MANUFACTURING) ZONE, IN THE YUCCA PORTION OF THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 3,1997, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above-described property as requested by Randy Lyles ofTemecula, California, being represented by William 1. Roper of Kingman, Arizona, and WHEREAS, this property is located south of Alamo Road and southeast of Interstate 40 in the Yucca area. The site is accessed from Interstate 40 via the Alamo Road Exit, to the east side of Interstate 40, then south, east, and southeast on Alamo Road approximately 4.5 miles to Ray Road, then south on Ray Road approximately two miles to Oscar Drive, then east on Oscar Drive approximately one-eighth mile to the continuation of Ray Road following the section line between Township 17 West and Township 18 West, then south on Ray Road to the site, located approximately 15 miles south of Oscar Drive. The property is vacant and relatively flat, sloping slightly to the northeast. The surrounding land uses consist of vacant (BLM) and railroad land. There are several significant drainage patterns crossing the property from the southwest to the northeast, and WHEREAS, the applicant requests this Rezone to allow for an automobile test track and a condominiums/shop complex. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, this item was first heard at the Planning and Zoning Commission meeting on July 9, 1997, and was continued by the applicant and staff due to several administrative errors, and WHEREAS, a review ofFEMA FIRM Panel #040058-3000B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area. Additional comments from the Mohave County Flood Control District: There are washes crossing this parcel-DO NOT BLOCK, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. . " . . There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 8, 1997, the Commission recommended APPROVAL for a Rezone of the SWV.. of Section 31, Township 15 North, Range 17 West, subject to the following: I. This property will be rezoned M-X (Heavy Manufacturing). 2. All residential uses in M-X (Heavy Manufacturing) zoning require a Zoning Use Permit. 3. All uses in M-X (Heavy Manufacturing) zoning require a Specific Use Permit. 4. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. The site plan shall show the location of the test track and the condominium/shop complexes. 5. The applicant shall provide permanent access to this property. 6. Ifmore than five (5) lots are created and sold by the applicant, a subdivision plan must be submitted in accordance with the Mohave County Subdivision Regulations. 7. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 8. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 9. If these conditions are not met within two years this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 18, 1997, and posted on October 17, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. ~ >" . . PAGE 3 OF 3 BK 2987 PG 624 FEE~976056~ RESOLtJTlON NO. 97-401 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 3, 1997, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
