WHEN RECORDED RETURN TO: GINNY ANDERSON, CLERK OF THE BOARD 700 W. BEALE STREET 3RD FLOOR KINGMAN,AZ 86401 MOHAVE COUNTY ORDINANCE NO. 2023-09 AN ORDINANCE SETTING FORTH AN AMENDMENT TO THE MOHAVE COUNTY BUILDING ORDINANCE 2021-03, THE BUILDING CODE ORDINANCE TO ALLOW FOR LOCAL AMENDMENTS. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on Tuesday, September 5, 2023, a public hearing was conducted to determine whether approval should be granted for an Amendment to the Mohave County Building Ordinance 2021-03, as requested by Mohave County, and WHEREAS, on June 7, 2021,the Mohave County Board of Supervisors ADOPTED Ordinance 2021-03 adopting the 2018 International Building Codes with local amendments, and WHEREAS, on July 12, 2023 the Building Code Advisory Board considered the draft amendment and recommended to the Planning and Zoning Commission and the Board of Supervisors that the proposed amendment be adopted, and WHEREAS,at the public hearing before the Mohave County Planning and Zoning Commission on August 9, 2023, the Commission recommended APPROVAL of this amendment to the Mohave County Building Ordinance, and WHEREAS,the notice of hearing for this Ordinance was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Arizona on August 20, 2023, and August 27, 2023, as required by Arizona Revised Statutes. NOW THEREFORE BE IT ORDAINED, that the Mohave County Board of Supervisors at their regular meeting on September 5,2023,ADOPTED this Ordinance to AMEND the Mohave County Building Ordinance 2021-03 as follows (wording to be deleted is straelF; wording to be added is bolded and double underlined): MOHAVE COUNTY ORDINANCE NO. 2023-09 PAGE 2 SECTION 11 AMENDMENTS AND DELETIONS TO TECHNICAL CODES A. The International Building Code, SECTION 1803 GEOTECHNICAL INVESTIGATIONS 1803.1 General. Geotechnical investigations shall be conducted in accordance with Section 1803.2 and reported in accordance with Section 1803.6. Where required by the building official or where geotechnical investigations involve in-situ testing, laboratory testing or engineering calculations, such investigations shall be conducted by a registered design professional. When an undated geotechnical report is completed,the recommendations o the new report will be accepted in lieu of the previous report. 1803.2 Investigations required. Geotechnical investigations shall be conducted in accordance with Sections 1803.3 through 1803.5. Exception: The building official shall be permitted to waive the requirement for a geotechnical investigation where satisfactory data from adjacent areas is available that demonstrates an investigation is not necessary for any of the conditions in Sections 1803.5.1 through 1803.5.6 and Sections 1803.5.10 and 1803.5.11. Satisfactory data may include geotechnical reports on adjacent areas and septic soils investigative reports on the subject property.
