WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 3, 1997, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by David 1. and Deborah Boye of Dolan Springs, Arizona, and WHEREAS, this property is located east of Pierce Ferry Road, approximately five miles northeast of the community of Dolan Springs. The site is accessed from Pierce Ferry Road via east on Nineteenth Street to Ocotillo Road, then south on Ocotillo Road to Seventeenth Street, then east on Seventeenth Street to Palo Verde Drive, then south on Palo Verde Drive to the site, located on the west side approximately 150 feet south of Seventeenth Street. The property has a garage and shop on it and the terrain is relatively flat, sloping slightly to the west. The surrounding land uses consist of vacant lots and a few scattered single- family residences, There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow a small manufacturing plant to make high quality folding and sheath knives for the outdoors. This location will not be a retail outlet; all sales are through mail order, catalogs and stores. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review ofFEMA FIRM Panel #04005 8-1800C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, this rezone action is to correct a zoning violation and is considered spot zoning, but this operation is fully enclosed and will not create any noise, pollution or other disturbances to the neighborhood, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 8, 1997, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property will be rezoned CoM (Commercial-Manufacturing). 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. In addition, a Limited Drainage Report will have to be submitted if any additional runoff is created by this development. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 4. All structures built on the property shall be compatible with the agricultural/residential nature o fthe area. 5. All manufacturing and fabricating processes shall be conducted within the structures. 6. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 7. If these conditions are not met within one year this approval will be void. Ifat the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 18, 1997, and posted January 17, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 3, 1997, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
