MOHAVE COUNT' RECORDf 02/05/97 02:56P PAGE 1 OF 3 MOHAVE COUHTY BOARO OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-41 A RESOLUTION SETTING FORTH A REZONE OF LOTS 1 THRU 540, GOLDEN HORSESHOE RANCHOS, UNIT 2, IN SECTION 7, TOWNSHIP 27 NORTH, RANGE 19 WEST, FROM R-l/IA (SINGLE FAMILY RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE), R-M/IA (MULTlPLE- RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE), C-2/1A (GENERAL COMMERCIAL/ONE ACRE MINIMUM LOT SIZE) AND A-R (AGRICULTURAL-RESIDENTIAL) ZONES TO A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 3, 1997, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by G.H.R. Development, Inc., being represented by Ralph J. McGrath, Corporation President, of Phoenix, Arizona, and WHEREAS, this property is located east of US Highway 93 and north of White Hills Road (County Route 145). The site is accessed from US Highway 93 via east on White Hills Road approximately seven miles to the site, located on the north side of White Hills Road encompassing all of Section 7. The property is vacant, with gently rolling hills, sloping slightly to the west. The surrounding land uses consist of Bureau of Land Management (BLM) land and privately owned ranch land. There are no significant drainage patterns, and WHEREAS, this subdivision was rezoned via P&ZC Resolution No. 69-94 on April 3, 1969. The following lots were rezoned from A-R (Agricultural-Residential) to: C-2/IA (General Commercial/One Acre Minimum Lot Size) zone: Lots 1,2,37,146,177,243 thru 246,331 thru 334, 349 thru 353, 365 thru 368, 409, 410,520,521, and 531 thru 533. R-M/IA (Multiple-Residential/One Acre Minimum Lot Size) zone: Lots 323 thru 330, 335 thru 348, 354 thru 364, 369 thru 375, and 534 thru 540. R-l/IA (Single Family Residential/One Acre Minimum Lot Size) zone: Lots 11 thru31,38thru47,50thru 71, 77thru98, 100thru 145, 147thru 172,178 thru 242, 247 thru 322,376 thru 408, 411 thru 519, and 522 thru 530. To remain: A-R (Agricultural-Residential) zone: Lots 3 thru 10, 32 thru 36, 48, 49, 72 thru 76,99 and 173 thru 176. RESOLUTION NO. 97-41 Page 2 ~ . . PAGE 2 OF 3 BK 2853 PG 17 FEE~97060, WHEREAS, the applicant requests this zone change to allow for single-family residences with horse privileges for private use on all 540 lots of this subdivision. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-1600B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect does not comply with the Mohave County General Plan, but it is a recorded subdivision. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 8, 1997, the Commission recommended APPROVAL for a Rezone subject to the following: I. Lots I thru 540, GOLDEN HORSESHOE RANCHOS, Unit 2, will be rezoned to A-R (Agricul tural- Residential). 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 4. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 18, 1997, and posted January 17, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. . . PAGE 3 OF 3 BK 2853 PG 18 FEE~970604" RESOLUTION NO. 97-41 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 3,1997, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
