MOHAVE COUNTY RECORDEi 02/05/97 02:55P PAGE 1 Of 3 MOHBOS RECORDING FEE 0.00 RESOLUTION NO. 97-37 A RESOLUTION SETTING FORTH A REZONE OF THE SOUTHERLY 326 FEET OF LOT 76, SUN WEST ACRES, TRACT 1027, IN SECTION 29, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-R/I0A (AGRICUL TURAL-RESIDENTIALrrEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/2A AND A-R/3A (AGRICULTURAL-RESIDENTIALfTWO ACRE AND THREE ACRE MINIMUM LOT SIZE) ZONES, IN THE GOLDEN VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 3, 1997, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by Charlotte Hoffmann of Golden Valley, Arizona, and WHEREAS, this property is located between Colorado Road and Verde Road, south of State Highway 68. The site is accessed from State Highway 68 via south on Verde Road to Bolsa Drive, then west on Bolsa Drive to San Pedro Road, then south on San Pedro Road approximately 700 feet to the site, located on the east side of San Pedro Road. The property is occupied by a single-family residence. The terrain is relatively flat and slopes slightly to the south. The surrounding land uses consist of vacant parcels and scattered single-family residences. There are no significant drainage patterns, except for the Cerbat Wash which runs from north to south along the westem portion of the site, and WHEREAS, the applicant requests this zone change to allow for development of the property. The applicant proposes to divide the 9.59-acre parcel into one approximately 4.8-acre parcel and two approximately 2.39-acre parcels. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area. Additional comment from Mohave County Floodplain: a portion of the parcel is in Zone C - site plan required, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan and the Golden Valley/Sacramento Valley Area Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. .- . . PAGE 2 OF 3 BK 2853 PG 6 FEE~9706042 RESOLUTION NO. 97-37 Page 2 d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, except for the Special Flood Hazard Area noted above. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 8,1997, the Commission recommended APPROVAL for a Rezone subject to the following: L The approximately 4.8-acre parcel will be rezoned A-RJ3A (AgricuItural-Residential/Three Acre Minimum Lot Size), and the two approximately 2.39-acre parcels will be rezoned A-RJ 2A (Agricultural-Residential/Two Acre Minimum Lot Size). 2. The submittal and recordation ofa Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. All rights-of-way dedicated and public easements granted on the Parcel Plat will be accepted by the Board of Supervisors upon Parcel Plat recordation. 4. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 5. Each parcel shall have legal access. The Mohave County Public Works Department recommends that 30 feet shall be granted to the public as an Ingress and Egress (I&E) and Public Utilities Easement (PUE). 6. The Parcel Plat shall show any surface drainage and FEMA flood zones. 7. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 8. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 9. If the required parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is not recorded within one year of Board of Supervisors approval, this rezone approval will be void. All other conditions are to be met upon the development of the property. Before the approval is declared void the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. . . "AGE 3 OF 3 BK 2853 PG 7 FEE~9 ~042 RESOLUTION NO. 97-37 Page 3 WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 18, 1997, and posted January 17, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 3,1997, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
