A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 96-411
SETTING FORTH AN ABANDONMENT OF A 25-FOOT INGRESS/EGRESS AND PUBLIC
UTILITY EASEMENT ON PARCEL C AS SHOWN IN PARCEL PLATS BOOK 1, PAGE 4, AND
ON PARCELS Al AND A2 AS SHOWN IN PARCEL PLATS BOOK 5, PAGE 32, IN SECTION 13,
TOWNSHIP 9 NORTH, RANGE 22 EAST, SBB&M, IN THE SOUTH MORAVE VALLEY AREA,
MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February
3,1997, a public hearing was conducted to determine whether an Amendment to BaS Resolution No. 96-
411, setting forth an Abandonment of a 25- foot Ingress/Egress and Public Utility Easement, as requested
by Roger and Elizabeth Sayles, et ai, of Kingman, Arizona, and
WHEREAS, language to be added has been bolded. Language to be deleted has been strtIek, and
WHEREAS, the site is in the South Mohave Valley, west of Highway 95 and north of Courtwright
Road. Access to the site is from Highway 95 via west on Courtwright Road to Dike Road, then
approximately one-quarter mile north on Dike Road to the site. The ingress/egress and public utility
easement to be abandoned is currently tlI10eetll'iea used by the Fort Mojave Tribal Utilities Authority.
The site is on the gently sloping east bank of the Colorado River, and
WHEREAS, Mr. and Mrs. Sayles, along with Mr. and Mrs. Drumm and Mr. and Mrs. Zentz, the
remaining applicants, own the four contiguous parcels which the easement passes through. Three of the four
lots are currently for sale, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the land described to be in
Zone A, a FEMA Special Flood Hazard Area, and
WHEREAS, following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The property is designated as an Urban Development Area.
c. The proposed action is in conformance with the Mohave County General Plan.
d. The Abandonment will not deny legal access to other private land holdings or deny any lot
from receiving public utility service.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
January 8,1997, the Commission recommended APPROVAL for an Amendment subject to the following:
I. That parcels under the same ownership be combined.
2. The public utility function ofthis easement shall remain.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, January 18, 1997, and posted January 17, 1997, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, February 3, 1997, APPROVED this Amendment as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
