MICROFILMID fNDEXEQ 9706040 BK 2853 PG 1 OFFICIAL RECORDS OF MOHAVE COUNTY, A JOAN MC CALL, MOHAVE COUHTY RECORDER 02/05/97 02:54P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-35 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE ACCEPTANCE OF AS- BUILT IMPROVEMENT PLANS FOR THE COMPLETION OF IMPROVEMENTS IN WILLOW VALLEY ESTATES, UNIT 20, TRACT 4134-A, BEING A SUBDIVISION OF A PORTION OF SECTION 21, TOWNSHIP 18 NORTH, RANGE 22 WEST, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 3, 1997, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for the acceptance of the As-Built Improvement Plans, to allow for the completion of improvements in the above described subdivision. This Extension of Time was requested by a representative for Burton Engineering, Inc., the project engineer, and WHEREAS, the owner is McKellips Land Corporation of Phoenix, Arizona, and WHEREAS, the subdivision is located approximately eight miles south of Bullhead City. The site is accessed via State Highway 95, then west approximately two miles on and north of King Street, and WHEREAS, the Final Plat for Willow Valley Estates, 20, Tract 4134-A, was recorded on August 16,1996. The Board of Supervisors conditionally accepted the As-Builts for this phase of the subdivision on June 17, 1996, per BaS Resolution No. 96-105. The conditions of that resolution have not been met, and WHEREAS, the representative for the engineer has indicated in a letter dated December 2, 1996, that an Extension of Time is being requested based on the following: "...The Willow Valley Water Company is experiencing a scheduling problem with the contractor. The water tank is to be moved on December 16, and cannot be scheduled any sooner. The work is anticipated to be completed between the 18th and the 20th of December. This means that the condition ofthe approval of BaS Resolution # 96-105, that the work be completed by December 15th (sic), will not be met", and WHEREAS, the Public Works Department has stated that continued compliance with BaS Resolution No. 96-105 is required, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The relocation ofthe subdivision water tank to the approved site appears to be in progress. PAGE 2 OF 2 BK 2853 PG 2 FEE~9706040 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 8, 1997, the Commission recommended APPROVAL of an Extension of Time for the acceptance of the As-Built Improvement Plans to allow for the completion of improvements in Tract 4134-A, subject to the following conditions: 1. Compliance with all of the conditions of BaS Resolution No. 96-105, except condition number lG. 2. Compliance with all of the conditions of BaS Resolution No. 96-341. 3. This Extension of Time will be in effect until April 17, 1997. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 18, 1997, and posted on January 17, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors at their regular meeting on Monday, February 3, 1997, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
